How can I force the payment of a bounced cheque amount as per the new law?
Hi,
I know the cheque bounce has been decriminalized. but someone gave me a cheque of 250k knowing that it will bounce because the bank account is closed.
What are the legal consequences for this, because it does not appear fair if there are no consequences, especially if the person has no funds.
I don't know if it is worth making a case with all the costs and no consequences. I appreciate any advice.

This is not true, there is a new law on cheques that obliges the person to pay the amount, and measures can be taken against him, such as imprisonment and selling his car and property.

A cheque bounce due to the account being forged is a criminal offense.
You must file a criminal case as well as a performance order case to recover the money owed to you.

Each matter will be subject to ascertaining what the intent of the person writing the bad cheque was at the time of doing so.
Should the person writing the cheque at the time, have knowledge that the cheque will be rejected, then this in principle will not apply, however, if it can be proven that there was no intent, then it will be decriminalized.
