س: السلام عليكم،
لدي استشارة قانونية بخصوص إيجار شقة.
استأجرت شقة من مالك بناية بعقد لمدة سنة ولم أستطع الوفاء بآخر دفعة وارتد الشيك الخاص بها.
طلبت من الشركة المسؤولة عن إيجار الشقة تقسيط الشيك وأبقى في الشقة، رفضت وطلبت مني إخلاء الشقة بدون أخذ أي أغراض منها.
أخذت الملابس والأشياء الضرورية وبقيت جميع الأغراض في الشقة. أخبروني أني أستطيع أخذ الأغراض في حال سداد قيمة الشيك.
حصلت ظروف واستمر الحال لأكثر من سنة ولم يتصل بي أي شخص من قبل الشركة إلا بعد سنتين تقريبًا بحجة عدم مقدرتهم على التواصل معي.
الآن يطالبونني بسداد قيمة الإيجار عن سنتين!
علمًا بأنني لم أسكن في الشقة طيلة هذه الفترة. ما الحل؟
لدي ما يثبت أنني لم أشغل الشقة؛ مثل فاتورة الكهرباء التي لا يوجد فيها أي مبلغ لأنها لم تستخدم منذ ذلك الوقت.
طلب مني المكتب إخلاء الشقة من الأغراض، ولكني أخشى حين أخلي الشقة الآن أن يكون ذلك بمثابة إثبات أني كنت أستخدمها!
أفيدوني باستشارتكم.

س: يطالبني المالك بإيجار عن فترة ما بعد إخلاء العقار بالرغم من أنني أبلغته بعدم الرغبة في التجديد ووافق مقابل غرامة تُستقطَع من التأمين لأنني أبلغته قبل أقل من ستين يوم من تاريخ نهاية العقد.
منحني مهلة عشرة أيام لنقل الأثاث وسلمته العقار وقام بمعاينته واتفقنا على الاستقطاعات من مبلغ التأمين والتي كانت تساوي مبلغ التأمين كاملاً تقريبًا.
أرسلت له براءة ذمة من المرافق وتم كل ذلك عن طريق محادثات إيميل وأبلغني أنني في انتظار شيك بباقي مبلغ التأمين، وكنت على علم أنه يعرض العقار للإيجار ولكنني فوجئت بدعوى ضدي بزعم أني لا أزال قاطنًا للعقار.
يطالب بطردي وأجرة حتى تاريخ طردي.

Q: My landlord is requesting me to leave the apartment at the end of tenancy period which is in 3 months. He hasn't requested this formally, I mean he only sent an email. Can this be counted?
I do not want to leave as I know the reason he wants me to evict is that he wants to increase the rent on the new tenant since I have been for quite some time.

My cousin has multiple penal judgments of fine and jail. How will this be calculated? 0
My cousin is in the central jail of Al Awir since October 2024 till date 20/03/25. She has 6 different penal cases all judgements are done, last one was done yesterday.
In total, she has a fine of about 135000, 1 month in jail, and deportation in 1 case.
How will this be calculated moving forward?
Also she has spent time in different police station detentions from 23rd May 2024 till October including 48 days or so in Ras al Khaima.

I am seeking urgent guidance regarding my current visa status in the UAE. I was previously employed by a company that has now shut down, but my visa is still under that company.
During my tenure, I held Power of Attorney (POA) for all financial matters. However, after a cheque issued by the company bounced, the owner revoked my POA without my knowledge.
