Q: Dear sir,
I have taken a loan from a bank, but I had to leave for my job. I am in the UK now.
I asked the bank to reduce the monthly installment as I have a relatively lesser salary here and can pay a limited amount every month, but the bank collection department refused my request and threatened to file a police case if I will not pay. How can I manage it?
I would be thankful for your response.

Proving the actual amount in a bank case for a personal loan
3
Q: Dear Madam,
I took a personal loan from a bank for AED162,000/- and paid AED 139,000/-. Now, the balance is 84,000/- (with interest).
I received information that the bank has filed a case for AED 219,000/-. I did not pay the monthly EMI of AED 4,538/- for more than 6 months due to job loss.
How is the bank filing a case for 219,000/- instead of the actual amount?
What is the procedure to reply to the bank against this case?
Please advise.
Thanks and regards,
S.

How to make debt settlement with the bank after finding a new job
2
Q: I lost my job last year because of the pandemic. I took a 3-month visit visa 2 times in hope of getting a job. But I ran out of funds and overstayed, as of the moment my fines are AED 7100 now.
I do have a credit card and personal loan and defaulted on my payments. As per the bank, they already filed a case against me. I am still waiting for a call from the Police.
A few days ago, I got a job offer. They told me to settle my issues before they process my work permit. I am afraid they will not wait for me if my issues are not resolved soon.
Is there a way I can waive or reduce my fines for overstaying?
How much will my fines be in the Police for a credit card limit of AED 9K and AED 18K, and my principal loan amount is AED 160K and had paid one year only?
Can I still get a visa if I pay the fines to the Police? Or I will go to jail? What will I do?

How can I settle a small loan that has grown a lot through the years?

1
Q: Hello Dear All,
I need legal advice please here. I don't have money to pay for a private lawyer as I'm currently not working. My situation is really bad.
When COVID-19 started, the company I worked for haven't paid me my salary and I have to take an evacuation flight to fly home.
I took a loan from a bank of AED 2750 and through the years it has grown to a crazy amount I will never be able to settle.
I offered the bank to settle AED 2750 amount if it's a few payments monthly, but not a straight one-time payment because I have no job.
But they only want a one-time payment and are not willing on negotiating with complete ignorance of my messages.
I was in touch with the bank and agency messaging me from time to time to settle the liability, and they currently messaged me that the bank is placing a travel ban against me.
They didn't explain what is the travel ban and which country it affects or how is it going to work.
Could anyone explain, please?
I'm lost and I don't know what to do.

The management of individual financial affairs is crucial and all the actions must be weighed down while committing to any financial liability. Whether it's job loss that may have lead to financial failure or the opposite, one must be aware of the personal liability which will not diminish by paying fines for cheque bounce cases. There are two major types of liabilities, criminal liability and civil liability. Each has its own significance, hence, must be dealt with accordingly.

View allCan the landlord request the tenant to pay the chiller in the middle of the contract? 0
I live in Dubai Marina, and the landlord claimed that according to new Dubai Land regulations, the chiller now has to be paid by the person occupying the apartment.
Even though my contract says that the landlord should pay the chiller, they want to implement this mid-contract.
I understand that the terms upon renewal will be renegotiated, but on what grounds can they implement the change mid-contract?
Does a new DLD regulation precede a tenancy contract? Moreover, I am receiving a disconnection notice from the chiller company due to non-payment.
What can I do if this happens?
Please advise.

Cleaner's resignation with 30-day notice in incomplete contract 0
Hello,
Good afternoon!
My friend works as a cleaner for a cleaning company and she now wants to resign with a 30-day notice. However, she has not completed the two-year contract and has only served for 16 months.
Additionally, she has not taken any vacation leave. The sad part is that when she signed the offer letter, she did not receive a copy of it and only signed it.
I would be very grateful if you could let me know if she would have to pay or if her boss has the right to not accept the resignation if the notice period mentioned in the offer letter is more than a month.
Her boss has not provided her with any kind of proof that she can use in the future if anything happens.

The ownership of a code of a web application 0
Hello,
I represent a tech-based marketplace company registered in a Freezone, in the UAE.
This is in regards to the UAE's law regarding the ownership of code when there is no clause mentioned in the agreement. One of our products (web application) is being developed by an agency in the UAE.
While we do have agreements in place, there is no clause regarding ownership of code. In the situation mentioned above, I've heard that the ownership of code either goes to the author or the agency that employed the author. Is this true?
Your assistance and help would be of great help.

How can I reach a settlement for unpaid rent with the landlord to lift the travel ban? 0
Greetings,
I have a rental case opened against me due to failed rent payments and bounced cheques with the flat since August 2021 based on failed business.
I had received a court order and a fixed amount to pay the amount in 5 installments. After that, I lost my job.
And after contacting a typing center on my rental dispute case, I learned I have a travel ban and an arrest warrant.
Even though I had the intention to pay, I had gone to the management with half the amount earlier before the enforcement case was opened and they refused negotiation.
Until now, I haven't been able to secure a job because I can't get a cancellation from my previous company and I don't have better means to pay the initial amount requested for the first installment.
Please, what can I do to at least get my name off the system to find a new job?
And how much out of AED 35,000 must I fulfill to lift the ban or arrest warrant while I settle the balance instrumentally?
Thanks.

The right response to the wife who is refusing to be with the husband 0
Hello/Salam
I am a British citizen with a UK passport and married a UAE resident with a Pakistani passport in March 2020. Due to Covid restrictions, I could not see my wife until travel re-opened.
At this time, I tried to apply for a UK spouse visa for my wife, but it was not approved on Jan 21. I then waited for things to re-open and visited my wife on Nov 21 and decided to move ahead with our Rukhsati and Walima in Jan 2022.
I then applied for her UK visit visa, but again it was not approved. I then traveled to Dubai in Mar 2022 to live in Dubai with my wife, but she did not see me, has not responded to my messages or calls, and blocked me on social media.
I was able to see her family but they were very disrespectful to me and threw me out of their house. I have returned to the UK now.
What can I do to approach the UAE authorities that my wife's family has defrauded me, taken all the gifts and gold, and are now ignoring us?
Please advise what can I do to save my marriage?
Thanks/Jzk

Will a medical condition be considered in defaulting on a loan? 0
Hello,
Please help, I was not able to pay my loan within 3 months for the amount of 841 monthly, because I had to undergo a major caesarian operation.
The balance amount of my loan is only like 17 thousand, and the bank deposited the 40,400 security cheque on my account so it will be bounced.
I can arrange the overdue balance, but the fines of the bounced cheque they raised are giving me a heavy load to settle.
They keep adding interest on my payment since before, even when I'm paying monthly regularly.
Please help and advise.
They said they will proceed to court. The interest is giving me too much heavy financial crisis.

The safest way to settle a bank loan without being arrested while coming back to the UAE 0
Hello Experts,
I need your kind advice regarding my loan.
I had a loan of 250k and a credit card of 13k with a bank. When I left the UAE in March-20, my cumulative outstanding of both was 160k. Since then, I'm in Pakistan and hasn't come back to the UAE
The bank has bounced security cheques and filed criminal cases. Now I have a job offer from Dubai and they already applied for my employment visa.
Meanwhile, I'm negotiating with the bank for a one-shot settlement over the telephone. They are asking me to pay 112k one payment for the full and final settlement of both liabilities.
They have waived off all the interest and just asking the principal amount in this way.
Please advise if 112k is a good deal considering the situation or I should have to get more discount.
Also, advise how should I go forward with them (they said, they'll issue a settlement letter/new offer letter, after which I'll submit the payment and then within 2 weeks they'll withdraw the criminal case).
