Q: Hello Legal Expert, A tour & travel company located in Dubai has promised many things at the time of selling tour package, however, they failed to provide services on the ground. After so much communication with them, they accepted the fact of their poor services and agreed to cancel my membership and promised to return my money. However, they keep deferring the date for money return. Later, they said that money will be returned in 6 installments through bank transfer; no post-dated cheques. I agreed to this proposal also. As per the last email from them, the 1st installment was due on 5th Jan, but again they failed to pay the money and always give new excuses. Q: I bought goods for (AED 400K) from a company in Jebel Ali - Dubai and they charged me 5% VAT which was not supposed to be charged because the goods are for export to an outside buyer. Now, they refuse to deliver the goods after 11 months. Can I sue them for fraud?

س: السلام عليكم، سؤالي هو أنني تعاقدت مع شركة لصنع الخزائن والأدراج بمبلغ 37800 درهم بتاريخ 17 يوليو 2020 وموعد التسليم 25 سبتمر 2020 حيث اتفقنا على تسليم دفعة أولى بمبلغ 4000 والباقي عدد 10 شيكات من 1 أغسطس إلى 1 يونيو 2021. لم يتم التسليم في الموعد المتفق عليه وصاحب الشركة يصرف الشيكات في مواعيدها الشهرية. أخذ صاحب الشركة يماطل ويعد بالتسليم دون جدوى. تقدمت للشرطة لفتح بلاغ فأعلموني بوجود بلاغات جنائية بحق الشخص ووجهوني لرفع دعوى نصب واحتيال. بالفعل بعد رفع الدعوى، تم فتح عريضة والقبض على الشخص، وبعد التحقيق أعطاه وكيل النيابة مهلة للتسليم والمهلة انتهت بتاريخ 26 نوفمبر 2020 ولم يتم التسليم! كيف أسترد حقي من هذا الشخص؟ وما تكلفة رفع الدعوى المدنية لفسخ العقد؟ وهل سأتمكن من المطالبة بتعويض؟ وما المبلغ الذي أستطيع طلبه؟

We are in the process of seeking a refund from our supplier (an LLC in Dubai) to recuperate funds from deposits we have paid for stock that we have never received. The total credit we have with the LLC is USD $68,030.62. This is split across 2 orders; the first purchase order is dated 4th March 2021, and payment was made on 9 March 2021, totaling USD $29,217.50. We then issued a second purchase order dated 26th May 2021, and payment was made on 3 June 2021, totaling USD$38,473.12. Total payments and credit on 3rd June 2021 were USD $68,450.62. The total goods received on 3 June 2021 were USD $420.00. Total owed to [------Ltd] on 3 June 2021was $68,030.62. This was delayed until November 2022 and is still not ready, we issued a formal order for cancellation on 14 December 2022.

This Law applies to merchants, as well as to all acts of commerce carried out in the UAE by any person even though he be not a trader.
