Claiming your passport from the public prosecution after bailing a friend
Q: Hi. I kept my passport as a guarantee for a friend in the public prosecution more than a year back. He left the country without telling me and hasn't come back into the country so far. In the meantime, verdicts were declared for his cases and he has to go to jail. So, he refuses to come back or settle the case. I am stuck here with my passport in court. I have tried setting up meetings with the public prosecutor but every time the online application gets rejected, even for a meeting with the public prosecutor. This has created a big issue for me and my family. Is there anything I can do to get my passport out?

Worksite accident and clearing the case at the court
Q: Hi Sir, Respected, My case is running in the Dubai Courts for one construction worksite accident that happened to one of our workers who fell down by his own mistake and hospitalized in the emergency. The case is running for 1 and a half year and the person who fell down is okay now, but the prosecution is saying it's 100% disability. For the victim, we had paid all the medical bill of AED 92000 + given all salaries till date, and due to a long time, we are in full stress and want to close the case from the victim and from my side. Releasing passport held for a work injury case at the court
Q: Hi Sir, I am K. I am working as a safety officer in a construction site. 1 year before, there was an accident to a worker, which caused fracture on the leg. He was given all the treatment necessary and waiting for the final operation next year Feb  (2020). For the last 1 year, the police are holding passports of our project manager, me, and the foreman. This month, I have one exam in India and I have to get back to India for that. I had also given resignation to my employer. How can I get my passport? Please advise me.

Possibility of bail in case of detention for construction site accident
Q: Dear Sir, I have my friend in detention in Al Barsha police station for accidental death in a construction site. His team on site had employed fewer labours for work and one of those guys died in an accident. The police had detained my friend as he is the owner of the company. The police case report number is only available and they have not still transferred it to the public prosecution. Is it possible to get bail before the case being transferred?

How long can the police hold a passport for investigation in a criminal case?
Q: How long can the police hold a passport (for inquiry) and travel ban without opening a case? The case is a breach of trust. Can you request the police to transfer the case to a public prosecutor since in my case the investigation is open for more than a month?

How to remove travel ban after closing a case for an accident on work site
Q: Good Morning Sir/Madam My name is S. and I am working in safety. There was a fatality at my site and a worker died. I was in Al Rashidiya police station and was released after two days after my passport was kept in the station. After two years, the police called us and informed us to collect the passport. The police prosecution didn't give any other documents but released our passport and said no more case. But when I was about to cancel my visa, the office at FAIC said that there is still a case under my name and I can't travel. Please advise, Sir.

How to claim your phone back from the police taken for investigation in a cybercrime?
Q: Hello I have a criminal case in the police station in Dubai regarding cybercrime, my phone was taken for digital forensics 2 months ago. I went to the police station and the officer said it’s been checked already and is now waiting to be transferred by him to the public prosecutor. But because he has a lot of cases, it can take a year so he advised me to submit a request to transfer it to the public prosecution and it would be faster. He also said that my case is not so bad and I probably should just get a fine. Should I believe him and go ahead with this application? Thank you

Can I travel outside the country if I have a criminal case?
Q: I have a criminal case of destroying property and a fine of AED 11 thousand. I last went to the prosecutor who told me the case is in court now, and they will call for the next step. My question is: Is it possible to cancel my travel ban as I'm traveling on vacation?

How to lift a travel ban imposed for a site supervisor after accident injury?
Q: I am in charge of a warehouse and we had an accident in the warehouse where one employee fell off the roof of the warehouse as he was cleaning it. He was not using any safety. He is injured in his arm and is back to work in 3 months. The company has paid all his medical bills and full salary during his absence. I am in charge of a warehouse and I have got a travel ban due to this case. How can I close this?

How can I vacate my tenant if the rental agreement ends before the eviction notice deadline?
My Dubai tenant's rental agreement is ending by the end of September 2024 and the completion of 12 months of legally served Eviction Notice is the end of December 2024. I have two questions: (a) Can I send a rent increase notice 3 months before as the rent has increased as per the RERA rent calculator? How can I reach a settlement with the bank for a mortgage of a jointly owned property?
I have a jointly owned property in Abu Dhabi. The mortgage was defaulted on as I had to leave the property with my children following an assault by my ex-husband. He left the country in 2018 and never paid the mortgage. As I was in the country, the bank filed a criminal case against me, and I was sentenced to 3 years. I won the appeal against the bank and then filed another criminal case a few months later in Dubai. Again, I won and paid a fine. In 2019, the bank started a civil case against me and my ex-husband to have the property repossessed. However, at the time of the purchase of the property, there were no Title Deeds, the bank requires this. I cannot give them the Title Deeds to sell the property and pay back the amount owed to them as my ex-husband refuses to provide a POA. The bank has filed another criminal case against me only for our jointly owned property. I wish to resolve this and pay off the bank and receive any money left from the sale. How can I resolve this issue of the Title Deeds?

Can a real estate agency hold a percentage of a property sale until transfer is done?
A real estate agency has signed an MOU stating that a 10% security deposit from the buyer and the seller will be kept in the real estate agency and will be released upon transferring the property. The transfer of the property was blocked due to the court order. According to my colleagues, the real estate agency is not a trustee and they are not allowed to have taken my security check in the first place, is this correct?
