س: السلام عليكم،
لدي مشكلة مع شركة في جبل علي. اشتريت منهم قطع غيار أونلاين وكان ينبغي التوصيل لدبي في خلال 3 أيام حسب الإفادة في الموقع وبناءً عليه تم الدفع أونلاين.
تم تأخير التوريد إلى شهر، فألغيت عملية الشراء بإرسال إيميل وكذلك عمل شكوى في حماية المستهلك. بعد أسبوع من فحص الشكوى، أفادني المسؤول أن أتوجه للمحكمة لعدم الاختصاص.
ذهبت إلى الشرطة فأفادوني بأنه خارج اختصاصهم وأن الموضوع مع حماية المستهلك! الآن مر على عملية الشراء شهرين كاملين ولا أدري كيف أتعامل وأي جهة يمكن أن تساعدني في استرجاع حقي!
هل إذا رفعت قضية وكان الحكم لصالحي يتحمل البائع أتعاب المحامي ورسوم القضية أم لا؟
مبلغ الشراء (11500) درهم.

رفع دعوى على شركة للإخلال بموجباتها التعاقدية

السادة الكرام
بخبركم سالفة استوت مع شركة تقنية متخصصة في تصميم المواقع و التطبيقات.
تعاقدنا وياهم على اساس يسوون لنا تطبيق ذكي لفكرة تجارية. ووقعنا العقد واشترطوا دفع مقدم، واعطيناهم. العقد تم من شهر 4 - 2017 بس للحين ما سووا شي ولا شفنا شيء. كل مرة يماطلون و يتهربون لين اختفوا و كنسلوا تلفوناتهم.
المعطيات اللي عندي ان الشركة مسجلة في منطقة حرة باحدى الامارات (مادري اذا مسموح احط اسم الامارة). تواصلت مع خدمة عملاء المنطقة الحرة، قالوا لي نعتذر ما نقدر نوفر لك المعلومات لأنك طرف ثالث!
طيب انا مستهلك و متضرر منهم، كيف اخذ حقي؟
حاليا قدمت دعوى مدنية بس قسم التدقيق في المحكمة الرئيسية طلب مني اعطاء عنوان كامل للشركة، وهالمعلومات ما اقدر احصلها عن طريق المنطقة الحرة اللي الشركة مسجلة عندهم لأنهم يرفضون التعاون. بالتالي الدعوى معلقة لحين اكمال النواقص.
علما ان المبلغ مب بسيط وهالشيء أثر نفسيا علينا.
شو الحل؟ طالبين مشورتكم.

Q: I represent a Libyan company that made a purchase of goods from Dubai.
In accordance with the legal procedures, I have sent a bank credit against bank documents.
The money was sent to Dubai and the company in Dubai sent bank legal documents to receive the money but did not send the goods.
How can I recover my physical rights?

The UAE Penal Code, like all other laws, addresses the crime of fraud in Article 399 of the UAE Federal Penal Code, which stipulates that whoever seizes, for himself or another, a movable property, or obtains a document or signature thereon, cancellation or destruction thereof or amendment thereto by fraudulent means, or by assuming a false name or capacity, where such an act leads to deception of a victim and leads him to surrender shall be punished by imprisonment or fine.

لمحة قانونية عن غرامة التأخير والفسخ في عقود المقاولة 0
عرف قانون المعاملات المدنية الإمارات في المادة 872 منه عقد المقاولة بأنه العقد الذي يتعهد فيه أحد طرفيه بأن يصنع شيئاً أو يؤدي عملاً لقاء بدل يتعهد به الطرف الآخر. وينقضي عقد المقاولة إما بانقضاء العمل المتفق عليه أو بالفسخ، وفي الحالة الأخيرة، يتم التعويض على الطرف المتضرر من الفسخ كما هم معمول به قانوناً وعرفاً.

I'm a nanny, and at the same time, I work as a housemaid (khadama) here in the house. I work, but as I know, the nannies and housemaids have different rights, and my employer doesn't give me rest.
My work starts at 7:30 am and then finishes at 10 pm or less. It depends on whether the baby is asleep or what time they will take on me if not yet asleep. Is this right?
Also, at the time of eating, I'm still working because the baby is with me, so I just let her sit in her chair. That's how I eat.
Please answer me. I want to know my rights.
Because if I can leave during the 6-month probation, I want to take it if the employer is this kind. I don't know.

My previous organization has not yet released EOSB because I contacted a client. Is this legal? 0
I recently joined a new organization in the Hamriyah Free Zone, and my previous organization has not released my end-of-service benefits.
The HR has instructed the finance team not to do so because I had contacted one of their clients.
In my DMCC contract, there is no Non-Compete clause, but the offer letter has one, and now they are not releasing the end-of-service.
Is this legal? What are my rights?

I have multiple cheque execution cases filed against me due to financial strains last year.
My trade license and visa will expire next month, along with my Emirates ID.
Is it possible for me to renew my license and visa along with EID prior to settling the execution cases?
The trade license and visa were issued by the free zone authority.

How to file a case against my former company for unpaid salary I was not on their visa? 0
Dear Legal Advice Middle East,
I hope you are well.
I am seeking legal advice regarding an unpaid salary issue with my former employer, [-----]2 LLC. I was employed with them from December 4, 2024, to January 7, 2025, on a monthly salary of 5,000 AED.
However, I only received a partial payment of 2,473 AED on February 24, 2025. The remaining 2,527 AED is still unpaid.
I submitted a complaint to MOHRE on March 2, 2025, but I am unable to proceed further through their official channels.
This is because I was working under the visa of my previous employer, [---] LLC, and not under [----]’s sponsorship.
As a result, I do not meet the criteria to file a labor complaint via the MOHRE app or hotline.
Given this situation, I would appreciate your guidance on how I can legally pursue the recovery of my remaining salary, considering the complications related to my visa status during the employment.
