Thanks for your fast response. We are based in Abu Dhabi.
Q.1 As we know that for a rent cheque bounce after the police case is closed and the civil case is opened, will the judge decide on the amount for instalments in this civil case? Won't he consider what we say how much we can pay?
Q.2 During eviction case, when the rent/lease expires and since the lease is now connected with Tawtheeq which expires as well, will ADDC cut my electricity during this time?
Q.3 My friend has a bank loan of AED 60K approx from a bank here in the UAE and he did not pay for the last 7 or 8 months. This bank has a branch in Pakistan.
If he travels to Pakistan due to an emergency and the bank proceeds with its action, what action(s) will that be? (So far no action from the bank)
Q.4 If he goes to Pakistan, what will be the consequences for an already running civil case of a bank loan default?
Q.5 for a credit card security cheque bounce, can a bank directly file a civil case?

Q: Civil case execution for payment of debt is there. The parties almost doubled the actual amount.
1. What if the person is unable to make the payment? What is the jail term and is it common for both cases?
2. The person is 65 years old. Is there any relief based on the age factor?

Can a bank threaten to file a police case for non-payment of a loan?

Q: Dear Sir/Madam,
I failed to pay a credit card loan to a bank. They are threatening to file a police case against me. They keep calling my manager at my company.
Can you tell me what will happen if they do file a case against me?
I received a statement from the bank with CID on it.
Does this mean I have a case now? And does it mean I can't travel?
Please advise!

What can I do if the bank is pressuring me after I defaulted due to redundancy and sickness?

Q: Dear Legal Advice,
I got redundant from work last June 2023. Until now, I have been unable to secure a job and I was diagnosed with breast cancer last Nov 2023.
I asked my previous company to hold my visa and insurance cancellation because I need the insurance for my tests, procedures, and treatments like chemotherapy and radiotherapy sessions.
But I have a bank loan and the bank called me and my previous company pressuring us to release the gratuity to the bank because I have 4 months overdue installments.
The bank is threatening the company that it will cause an issue because there is no salary reflected in my account; they are forcing them to cancel my visa and release the gratuity.
The bank is forcing me to send an email to my company to release my gratuity. If I do this, I will have no visa and insurance, my chemo sessions will be stopped, and my health will be at risk.
What should I do?
Does the bank have the right to force me and my company?
Please I need your wise advice.

Cleaner's resignation with 30-day notice in incomplete contract 7
Hello,
Good afternoon!
My friend works as a cleaner for a cleaning company and she now wants to resign with a 30-day notice. However, she has not completed the two-year contract and has only served for 16 months.
Additionally, she has not taken any vacation leave. The sad part is that when she signed the offer letter, she did not receive a copy of it and only signed it.
I would be very grateful if you could let me know if she would have to pay or if her boss has the right to not accept the resignation if the notice period mentioned in the offer letter is more than a month.
Her boss has not provided her with any kind of proof that she can use in the future if anything happens.

العميل سدد المبالغ التي استخدمها ورفض دفع مبالغ الفائدة البنكية. هل يجوز ذلك؟ 2
السلام عليكم،
هل يحق للبنك في إمارة دبي أن يرفع دعوى جنائية أو مدنية ضد عميل لم يسدد مبالغ الفائدة بل سدد فقط المبالغ التي قدمها البنك أصليًا (مبلغ القرض فقط)؟
منحه البنك بطاقة ائتمانية بحجة أنه "قرض حسن بدون فوائد"، وبعدما استخدم العميل البطاقة الائتمانية بفترة زمنية قصيرة وفجأةً تم إرسال رسالة إلى العميل تفيد بأن هناك مبالغ متراكمة بسبب الفائدة البنكية بقيمة ٤٠٪ من القرض الأساس المُقدم إليه.
علمًا بأنه تم تزويد العميل بالبطاقة الائتمانية عن طريق البريد السريع لعنوان منزله بدون طلب رسمي من العميل بذلك، بالإضافة إلى أنه لا يوجد أي من المستندات التالية بين البنك والعميل:
١- عقد. ٢- اتفاقية. ٣- شيكات كضمان. ٤- سند أو شريعة أو قبول خطي أو غير خطي أو توثيق يتضمن أي توقيع من الأطراف؛ بمعنى آخر، لا يوجد أي اتفاق على الإطلاق.
العميل سدد المبالغ التي استخدمها ورفض دفع مبالغ الفائدة البنكية المضافة سالفة الذكر.
