س: السلام عليكم، عقدي مُحدد. فُصلت بعد إنذار بتاريخ 12/03/2020. هل أستحق ثلاثة أشهر حسب القرار الوزاري 765 وكذلك ثلاثة أشهر فصل تعسفي حسب المادتين 122 و123؟ إضافة إلى مكافأة نهاية الخدمة وبدل الإجازات وتذكرة طائرة؟ شكرًا لكم!

Q: Dear Madam, My name is R. S. working as a facilities maintenance supervisor in Shariah, UAE. My employer terminated my unlimited contract with one-month notice period (Arbitrary Dismissal) and provided me with all benefits with notice period payment of one-month full salary. I requested the company to pay compensation salary for an additional 3 months with my yearly bonus of 1.5 months salary. The company did not agree and I filed a formal complaint at MOL online, but the mater is not solved yet and MOL transferred my case to the court. Kindly advise what is the actual benefits I have to get as per the UAE employment labour law. Still, I am requesting at least to pay compensation of 2 months' salary and they are not ready to pay. Is it advisable to solve my issue at the court? If not, please advise what is my right and further step.

Q: Good afternoon, I have been working in a private firm for the last 13 years in an unlimited contract. Now, I have been terminated as per their part of downsizing. My notice period would complete by the end of April. Since 2006, I'm working in the same company, starting my salary was 3500 and my basic was 2500 then upon increments they added all the increments in others category. They never changed the basic from 2500 and now my salary is 12000. In 2017, they forced me to change my visa from the branch to head office license due to the branch license closure, and that time, they needed to change my basic as per my salary so they put 7500 as my basic. During that of renewal, I signed a new employment contract mentioning the new basic, I have the document with me as well. My question is, am I eligible for 3 months' salary and whether these 3 months include the notice period or apart from that is 3 months? Will my gratuity be calculated based on the new basic or old basic salary? Thank you.

س: أنا مواطن أعمل في إحدى شركات بترول أبوظبي. بعد 5 أعوام تم استدعائي للشركة وطلبوا مني التوقيع على عقد عمل جديد بوظيفة عامل بالدرجة 6 أو 5 علماً بأني كنت بوظيفة مشغل بالدرجة 10، وعلى أن أبدأ من جديد فترة تجربة 6 أشهر بفئة متدرب والعقد السابق لاغي. رفضت ذلك فتم إيقافي عن العمل وإيقاف راتبي وإدخالي للجنة المخالفات بشكل أسبوعي لمدة 7 أشهر دون أن أقوم بأي مخالفة. ثم تم خداعي بأن اللجنة قررت فصلي بقرار تأديبي، وعندما طلبت رؤية القرار ادعت بأنه حتى الآن لم يصل ولكنهم أنهوا خدمتي قبل 4 أيّام. فكيف لم يصل حتى الآن؟ طلبت مني التوقيع لحين وصول القرار ولكني رفضت التوقيع على أي شيء حتى أرى القرار. وبعدها قامت الموظفة بطباعة كتاب الفصل وقام أحد الموظفين بالتوقيع عليه، وطلبت مني التوقيع فرفضت لعدم وجود القرار أساساً وهذا الكتاب باطل. بعدها خاطبوا صندوق التقاعد بطلب شطبي من سجلات موظفي الشركة وادعوا بسبب انقطاعي الطويل عن العمل وأنهم لم يتمكنوا من الوصول إلي لأقوم بالإجراءات، وقاموا بالإجراءات بالنيابة عني وتم صرف المستحقات وقاموا بخصم ربع المكافأة. هل يستطيع القضاء إرجاعي لعملي ان قدمت إثباتات على ما أدعيه؟

س: السلام عليكم، إذا فُصِل شخص من العمل فصلاً تعسفيًا وتم إنهاء الخدمة بدون إنذار في نفس الوقت، فهل يطلب بدل الفصل التعسفي وبدل الإنذار؟ صاحب العمل برر إنهاء الخدمة بأن العامل يتعامل مع ناس، لم يحددهم، وأساء للسمعة وقد هدد بكسر الرأس إذا تم رفع دعوى. هل يطلب عن هذا الضرر المعنوي تعويضًا من القاضي العمالي مع نفس الطلبات العمالية؛ الأجور والإجازات وغيرها؟ وشكرًا!

The UAE has adopted a major reform in its legislative system that brought about 40 new laws and amendments to the company law, criminal law, personal status, among others. The amendments aim to develop the legislative structure in various sectors, the labor law being one of these, was the most recent. The provisions of this Law, known as "UAE Labour Law", govern the relationship between employers and employees and other labour matters in the United Arab Emirates. There are special labour related regulations applicable in some of the free zones in the UAE.

This Decree sets the rules and conditions for the termination of fixed-term (limited) or unlimited (not term-bound) employment contract between employer and worker in the United Arab Emirates.

The provisions of this Decree-Law, known as "New UAE Labor Law", govern labour relations in the private sector of the United Arab Emirates. The New Labor Law repeals the previous UAE Labor Law (Federal Law No. (8) of 1980).
