Can a Muslim convert marry in the UAE while separated from a non-Muslim ex-husband?

Hello,

I have been separated for 7 years from my late ex-husband in the Philippines.

I am a converted Muslim since 2016, and my ex-husband was not Muslim.

Can I marry my Egyptian fiancé here in the UAE?

Dear questioner,

There is no problem with marrying if you have documents of divorce.

Dear Inquirer,

Since you converted to Islam in 2016 and your ex-husband is not Muslim, you are eligible to remarry under UAE law.

As you have been separated for 7 years, the marriage can proceed, provided you meet the necessary legal requirements. Your Egyptian fiancé would need to fulfill specific documentation and procedural steps as well.

To ensure everything is handled correctly and efficiently, we recommend booking a consultation with us or assigning a legal representative to guide you through the process.

Hello,

The answer depends on resolving the issues mentioned above, particularly your marital status, and ensuring you meet the UAE’s residency and documentation requirements.

If you are officially divorced or your previous marriage is annulled, and you have the necessary documents (including proof of your conversion to Islam and medical fitness certificates), and at least one of you is a resident of the UAE, then yes, you can proceed with the marriage in the UAE, following the country’s Islamic marriage laws and procedures.

Yes, I have an Islamic certificate.

Thank you!

Greetings,

"Late husband" means that he is not a living human being anymore, because "my late husband" refers, of course, to a husband who has died recently or is lately dead.

The phrase "my ex" also connotes that you are divorced and no longer husband and wife. If that is the case, and you are now engaged to another man (fiancé), then yes, you can marry.

On the other hand, if the wedlock is still in place between you and your husband who still lives in the Philippines, and you have converted to Islam, then you must first apply for divorce to terminate the first relationship and observe the waiting period (Iddah) before entering into any kind of relationship.

Even being engaged to a man while still a spouse of another is in contravention of Islamic law and the general principles of Islam.

We are happy to assist you!

Best Regards,

Hello,

You’ve been separated from your late ex-husband in the Philippines for 7 years, and you’ve been a Muslim since 2016, while your ex-husband was not a Muslim.

Yes, you can marry your Egyptian fiancé here in the UAE. However, there are some legal requirements you need to fulfill, such as:

- Providing proof of separation or divorce from your previous marriage (divorce certificate or court decision).

- A certificate of conversion to Islam (if required for the marriage process).

- Ensuring your Egyptian fiancé is legally eligible to marry (i.e., not currently married or has the required permission if previously married).
