Enforcement of court decision against a developer

Q: We won a court case against a property developer in Dubai back in November of last year. The court has issued an order of execution against the real estate developers assets.
It has been now more than 3 months that this order has been issued and our lawyer keeps saying that the court can't find the assets even though the real estate developer have a project in construction and has advertising on billboards, buses, gas stations all over the UAE.
What can we do in this instance and how can we make sure that the order is executed and we get our money back?

Can claimant withdraw a case when it is with Public Prosecution?

Q: Dear Lawyer,
A company in Jebel Ali filed a case of fraud at Police station. The company asked me to pay a certain amount after adjusting against my final dues. I paid and cleared.
Later on, they started blackmailing me by asking me to pay the legal costs incurred by the company. Then I complained to the Ministry of Labor saying that my passport is held by the employer. Now the Police station has transferred the case to the public prosecutor along with my passport on 10th of April.
I need to know how long will it take for the hearing to happen (waiting for the call from the Dubai Court) and secondly can the employer withdraw the case when it is with public prosecution? If yes how? Please advise.

Does company-plaintiff need to renew its trade license?

Q: Dear Sir,
I have a little inquiry. My company Techno Links Trading Co. LLC has a case in the court. There are two companies in Abu Dhabi that owe us money since 2010. One is Al Maraikhi and other is Al Mushrif. The court has ordered in our favour.
Now it's been more than a year we are still waiting for the payment. The problem is we don't want to renew our company's license as there is no business these days but if we don't renew we won't be able to collect money from them.
Is it possible if we end the company would we still be able to get our money from them in future?

Labor case judgement execution

Q: A labour case was ruled in my favour and I received the judgement at the end of 2016. The judgement progressed to execution and not One Dirham has been paid by my ex-employer to date.
We have spent the last year searching assets in all banks, combined with real estate, RTA etc. and all have come back with no assets. An attachment was made on the office assets, shortly after the Rental Dispute Committee issued a Judgement awarding the office assets to the Landlord.
Finally, we located a valid Bank Guarantee held with a Government Authority. But the entity is not cooperating.
As per Federal Law No. 8 for 1980 On Regulation of Labour Relations, Article 4 gives priority over all assets.
However, in this scenario, Federal Labour Law, Dubai Real Estate Laws and further laws are all overlapping and conflicting.
My query is, is there a document or law that states which law has priority over another to help resolve the issues I am facing with the judgement execution?

Paying the fees of expert appointment in the UAE courts

Q: Hi,
I have a labour case in Sharjah Court against my employer.
The judge said that my case has been transferred to the "expert service" in the last hearing and I have to pay AED 4000 for that. The next hearing date has been appointed on 25.11.18 and 25.12.18.
I am kindly asking you to clarify:
1) What does it mean "labour case transferred to the expert service"?
2) Should I pay AED 4000 for "expert service" if it's optional? As the secretary of the judge explained to me that I can ask the judge not to pay (I do not have money) or partial payment.
3) Can I refund the total amount of "expert service" fee, if I win the case?
4) Will the payment of "expert service" fee affect the court decision or end date?

Referring a case from the court of cassation back to appeal

Q: I had a commercial cassation case in Dubai. The honourable court remanded the case back to the appeal court with a new tribunal.
My Question: Will the court automatically register a new appeal case for me? Or do I have to register a new appeal case myself?
I also need a lawyer to represent me in this case.

If expert fees go unpaid, will it lead to case dismissal or an unfavorable judgment?

Q: Dear Sir/Madam,
I have a real estate claim case in court, with several sessions held. The defendant only appeared for one session.
On judgment day, the judge requested an expert appointment, which costs 15,000 AED.
If it’s not paid, will the judge dismiss the case or will the judgment be unfavorable to me?
I received a very short notice period to pay the fee.

How to guarantee my right in accrued leave days or payment 1
Dear Sir,
My contract is a fulltime employee for a company in the UAE, and my leave entitlement state 10 weeks work and 2 weeks off.
However, due to the COVID-19, I have been unable to take that leave and have accrued two months leave or 61 days with four flight tickets.
My question is, can my company legally cancel those accrued days at the start of the new year or would they have to pay me for those days?

How to guarantee labour rights before signing the cancellation paper 1
Good morning All,
I was terminated by my company in March 2020 for not signing the unpaid leave document given to me. I was terminated on 23rd March 2020.
Once termination letter was signed, ever since then, I have been chasing my ex-company for releasing the final settlement and each time they come up with a different plan.
The last option they gave was to sign an agreement with them for 6 months plan but are not giving me any guarantee cheques and insist that I sign the cancellation papers. I want to simply take my money and leave the UAE.
They have also directed me to their lawyers now who insist that any agreement signed with the company is not required to be notarized by Dubai Courts and the company is not legally bound to give me any cheques as a guarantee.
The company that I worked for is located in Dubai and is a private organisation.

Following up on a labor case after traveling to the home country 2
After working for my employer for nearly two years on an unlimited contract as a COO of a restaurant company, my employer owes me approx 193000, not including notice period.
I have filed a case with the MOHRE. They have tried to contact the employer who has ignored the calls and is also ignoring me.
I know that I will have to escalate the complaint but, based on experience with the way the employer treats past employees and how he ignores suppliers and landlords, it is fair to assume that he will ignore this as well.
I have little options and I have to leave the country as the apartment rent paid by the company expires mid-July. If I leave, can I maintain the complaint, and what is the likelihood of getting the money owed in this scenario when I travel back to the UK?
