Can claimant withdraw a case when it is with Public Prosecution?

Dear Lawyer,

A company in Jebel Ali filed a case of fraud at Police station. The company asked me to pay a certain amount after adjusting against my final dues. I paid and cleared.

Later on, they started blackmailing me by asking me to pay the legal costs incurred by the company. Then I complained to the Ministry of Labor saying that my passport is held by the employer. Now the Police station has transferred the case to the public prosecutor along with my passport on 10th of April.

I need to know how long will it take for the hearing to happen (waiting for the call from the Dubai Court) and secondly can the employer withdraw the case when it is with public prosecution? If yes how? Please advise.

I hope you are doing well. The breach of trust is a crime that even if the claimant withdraws his right, still the public prosecutor, if he sees that the pieces of evidence are available, he would transfer the case to the court.

However, practically, the judge usually opt to rule the minimum penalty in case there is no claimant.

There is no specific time for the procedures of setting the date of the first hearing, now the file with the public prosecutor as you have mentioned, thus, he will summon you for investigation and later on, it might take one week or more for the public prosecutor to transfer the file to the court, and they will notify you several days prior to the session.
