RERA vs. Rental Valuation Certificate: Which will the Rent and Dispute Center follow?

Q: Dear Sir/Madam, I sent my tenant in Dubai a rent increase notice before the 90-day period required by RERA. The RERA rent calculator does not allow any rent increase in this case, but I requested a Rental Valuation Certificate from the Dubai Land Department, which showed a rent increase. According to the law, which one will the Rent and Dispute Center follow?

س: السلام عليكم، هل يستطيع شخص مُبعد من دول مجلس التعاون الخليجي المرور بها عن طريق الترانزيت؟ علمًا بأن القضية جنائية كانت في السعودية وقضيت العقوبة هناك، وبعدها ذهبت إلى الإمارات، وبعد قضاء سنتين تم الترحيل من هناك أيضًا على إثرها. الآن سأسافر إلى دولة روسيا ولكن عن طريق الترانزيت.

The landlord wants to increase rent above RERA Index. How to renew my contract?

Q: My landlord was asking for an unjustified rent increase of 9K, while the RERA calculator showed 3K. He was threatening to go through the Rent Valuation process, however, he only gave me a notice period of 83 days. According to Dubai Decree No 43 of 2013 and Law No 33 of 2008, landlords are required to provide a 90-day notice period before making any changes to the rental contract, including increasing the rent amount. Failure to comply with this notice period entitles the tenant to refuse the rent increase. As the current contract is coming to an end by the end of next week, I have made several attempts to reach out to my landlord and his real estate agent to reiterate my interest in extending the contract and collecting the rental cheques at the old prices. Also, I kindly requested that they provide me with the contract as soon as possible. Unfortunately, I have not received any response thus far, and considering that this week is a holiday week, I do not know what to do. Sincerely,

Q: Salamu Alaikum. There is a case against me for a cheque bounce from a credit card provider and I am abroad. I know the case number and amount of the cheque. How to get the penalty and how to pay when I am abroad? If I hire a lawyer, how much is it going to cost me, and how long will it take to clear my case? I need a police clearance certificate so I can visit the UAE again.

Which date does the tenant vacate: lease end or notice date?

Q: Dear Sir/Madam, I bought a property that was transferred to my name a few days ago. The previous owner had served a legal notice to vacate (reason: sale) and renewed the lease agreement for 9 more months three months after serving the notice, to align with the notice to vacate. After the transfer, I was able to access Ejari via the Dubai Rest app and saw that Ejari was renewed for 12 months instead of 9 months. Does this mean that the tenant has the right to stay until the end of the Ejari date or the date on the legal notice and lease agreement? FYI: The date on the notice served via the Dubai Court is January 31, 2024. The lease agreement is January 31, 2024, but Ejari is April 30, 2024. My wife and children are moving to Dubai by February 2024, and I need the house for myself. Please help!

Can I travel to work in Qatar if I left the UAE with pending loans and credit card?

Q: I have worked in the UAE, but unfortunately I lost my job after the company forced me to resign. This was last 2017. Due to job loss, I was unable to pay my bank loans and credit card. Banks still keep sending me emails about unpaid loans and credit card. I now need to travel to qatar due to work, what are the consequences if there is a travel ban and a civil case is raised in the UAE or GCC countries? Can I enter Qatar? Would I be arrested? Q: Can a tenant refuse to leave my house although he has agreed and signed a clause in the tenancy contract? The contract stipulates that if the owner finds a buyer for his property, the tenant will leave within 90 days of being informed and he will get an AED 31000 compensation.

I left the UAE with a small unpaid loan and now I have to transit in Dubai. Will I be arrested?

Q: Greetings! I am a Philippine passport Holder. I was working in the UAE for the past 16 years. I have a personal loan of AED 1,500 in a Bank in Abu Dhabi. How to evict a tenant in Dubai as a new owner before receiving the title deed?

Q: Hi Legal Advice ME, I have just bought an apartment in Dubai with a tenant in place. I would like to move into the apartment as my residence. I understand that I must issue the current tenant a 12-month written notice. However, I have only received the sale and purchase agreement (SPA) from the developer so far. Do I need to wait until I receive the title deed before issuing the eviction notice? Also, the current Ejari is between the developer and the tenant. Can I still issue the 12-month notice even though the current tenancy contract is with the developer?

Can I enter the UAE without getting arrested if I have a pending credit card debt?

Q: I left Dubai in 2017 with a credit card debt of AED 40,000 left due to illness. Since then, I`ve been attempting to negotiate a payment plan with the bank. However, they consistently reject my offers and insist on full payment in one lump sum. I have repeatedly asked for documentation and proof of the debt but in the last 6 years, the bank has failed to provide any proof or documentation. I check regularly and no police report has been filed against me. Recently, I was notified by the bank that they have lost my security cheque and therefore cannot file a police report. Is this true? What implications does this have on my UAE status? Can I safely enter the UAE without the risk of arrest?

Is it worth filing a case for compensation if the landlord evicted me and did not sell?

Q: My landlord has asked us for a 33% rent increase and I responded by informing him that according to Dubai law, the maximum rental increase he can impose on me is 20%. He then replied back and gave me 24 hours to respond and agree to the 33%, or else he will evict me (all communications have been done through email). 2 days later, I received a 12 months eviction notice through the notary. The eviction said it was for the reason of selling his property. Fast forward, I moved out at the end of the 12 months. Then less than 2 months later (48 days later), he rented the property to another tenant for a higher price (I have managed to obtain a copy of the Ejari of the new tenant). My question is: Is it worth it to go to the RDC and file a case? Or is this a gray area in the Dubai rental law, and there is a chance that the judge won`t order the landlord to pay any compensation? Please let me know what is the success probability here.
