Appealing a labor case if the claim value is below 50,000 AED?

Can you request the first instance court to review a labor case if the amount of the claim is below 50,000 AED?

Dear Questioner,

According to the Civil Procedure Law 42 of 2022, Article 29, paragraph B, judgments issued by the Court of First Instance are considered final if the claim value does not exceed AED 50,000.

Therefore, appealing the judgment is not permissible if the claim value is AED 50,000 or less, except in exceptional cases mentioned in Article 160 of the law.

Appeals can be made against judgments and decisions within the final jurisdiction threshold of the Court of First Instance due to violation of jurisdiction rules related to public order or the occurrence of nullity in the judgment or decision, or nullity in the procedures affecting the judgment or decision.

All judgments or decisions can be appealed within the final jurisdiction threshold if the judgment or decision contradicts a previous judgment or decision that has not acquired the force of res judicata.

In this case, the previous judgment or decision is considered to be appealed by the force of law if it has not become final when the appeal is filed.

In these cases, the appellant is required to deposit a security of AED 2,000 with the appellate court upon filing the appeal.
