The landlord wants to increase rent above RERA Index. How to renew my contract?
My landlord was asking for an unjustified rent increase of 9K, while the RERA calculator showed 3K. He was threatening to go through the Rent Valuation process, however, he only gave me a notice period of 83 days.
According to Dubai Decree No 43 of 2013 and Law No 33 of 2008, landlords are required to provide a 90-day notice period before making any changes to the rental contract, including increasing the rent amount.
Failure to comply with this notice period entitles the tenant to refuse the rent increase.
As the current contract is coming to an end by the end of next week, I have made several attempts to reach out to my landlord and his real estate agent to reiterate my interest in extending the contract and collecting the rental cheques at the old prices.
Also, I kindly requested that they provide me with the contract as soon as possible. Unfortunately, I have not received any response thus far, and considering that this week is a holiday week, I do not know what to do.

You need to legally present the rent checks to the landlord by depositing them at the Rental Disputes Center under an "Offer and Deposit" file.
Afterward, if the landlord does not provide you with the lease agreement, you should file a case for "Delivery of Ejari" to compel the landlord to provide you with a documented lease agreement.
The judge will rule in your favor and fulfill your requests since the lease agreement is considered automatically renewed by law.

Actually, this 9K increase is according to the market prices, and also he got this evaluation of Dubai Land.
If you want, you can send an email to him that as per the law, he should send 90 days' notice, and according to RERA index, his increase is only 3K.

As a tenant, you have the right to file a case against the landlord and deposit your rental cheques with the Rent Dispute Centre.
After the judge issues a decision to provide you with a tenancy contract for the new period, the landlord can collect rental cheques from the RDC
