Q: Dear Sir/ Madam,
In my offer letter, the designation is Accounts Manager; however, since I have not attested degree certificates the employer promised to give me Archive Clerk Visa. They took my thumb impression and signature on blank paper and later they issued me a Messenger Profession Visa.
When I inquired about the same and refused to accept the Messenger Visa, they are blaming me that I agreed to this Messenger Visa and asked me to pay the visa costs and leave.
I sent the resignation and agreed to pay the visa cost, but the visa cost is double what they have quoted.
Note: the visa is not stamped on my passport. Will I get any ban from MOL, if the visa is cancelled?

Upgrading designation and salary upon changing job duties

Q: I am an employee in a company in Dubai since the last two years, with an unlimited contract and my total salary is AED 3000 (Joining date: 01/01/2016).
In the first year, I was doing an operational activity in a logistics company like documentation of all import/ export Inquiries (Designation in visa: Client Service Clerk).
In addition, I was helping the accountant as an assistant because the management decided that I shall help him in accounts. I am an employee with a postgraduate degree (M.Com Degree).
On the 4th January 2017, our accountant (Designation: Accounts Manager) left the company due to personal reasons. His salary was while joining AED 5000, and when he left the company after two years and a half that time was AED 6200.
The management asked me to take the position of an accountant and I accepted it. I was thinking that I will get AED 5000 salary of an accountant from the next month, but till this date, after 10 months, I am getting AED 3000.
I asked several times to change my designation and upgrade my salary, but they are giving the same answer that the company is at a loss.

Can I reject a job offer after signing the MOL offer letter?

Q: After getting an offer letter from a company, I was called on 3 months tourist visa to the UAE.
I went there as the offer was very good then after 10 days they took my signature and thumb impression on MOL offer letter and they said they will apply for my visa. But it's almost a month, they never came back and I decided to inform them and I left the country.
In the meantime, I got another offer letter from a different company and then they sent me MOL offer letter and then told me to wait for 10 days for complete process.
Now after googling I can find out the first company contract can be seen online at MOL website. Will this impact the new employer for MOL approval?
Note my first company have not applied for an entry permit or status changed as they have not taken my degree mark-sheet attested.

Significance of the job title and designation on labour contract

Q: I had signed an unlimited contract with a Dubai based company.
In the offer letter, I was given a designation as Business Manager with salary AED 30,000/month. However, in the MOHRE contract, my designation is showing Sales Executive having 4th/5th level skill.
When I inquired from them, they told me that the designation in MOHRE contract will not have any adverse effect during my stay in Dubai and they have mentioned 4th/5th level skill in the contract because my certificates ( B Tech ) are not HRD attested ( in India ) and they will not be able to wait for long for this attestation.
My questions are:-
a) Is this procedure legal i.e. getting a person of Engineering degree in 4th/5th level skill set?
b) Will it be possible to change the skill level in MOHRE contract if I get my degree attested by HRD and UAE consulate after I land in Dubai?
c) What are the possible issues that I will face?

أنا من الهند وقد تم اختياري للعمل مع إحدى شركات التشييد والبناء في الإمارات العربية المتحدة. في الحقيقة أنا مهندس مدني خريج BTech. عملت كمهندس مدني في الهند لمدة 3 سنوات وستة أشهر.
قدموا لي خطاب عرض العمل كعامل مدني، لكني طلبت منهم أن يعطوني الخطاب بوظيفة مهندس مدني. سأقبل التأشيرة كما هي بعامل مدني
إنهم يحاولون إقناعي بدخول الإمارات بتأشيرة عامل مدني. سوف يغيرونها إلى مهندس مدني طبقًا لما قالوه.
هل هناك أي صلة بين خطاب العرض وعملية التأشيرة التي يتعين علي توقيعها؟
من فضلك ساعدني في هذا الشأن.

إنني أعمل لدى شركة ذات مسؤولية محدودة مقرها في الداخل بدبي بموجب عقد عمل محدد المدة. لقد أكملت سنة واحدة من العمل لدى هذه الشركة.
تعمل الشركة في مجال صيانة أنظمة الإطفاء والسلامة من الحرائق. لقد تلقيت عرضًا من الشركة لتولي وظيفة فني كهرباء لأنظمة الإطفاء والسلامة من الحرائق.
وفقًا لعقد العمل الصادر عن وزارة العمل والتأشيرة الخاصة بي، إن وظيفتي هي فني كهرباء، لكن للأسف، لا يوجد لدى الشركة التي أعمل بها أي وظائف تتعلق بالنظام الكهربائي. لقد كنت أقوم ببعض الوظائف الأخرى مثل تنظيف مطفأة الحريق ووظائف التحميل والتفريغ خلال العام الماضي.
في الوقت الحالي أريد الاستقالة من هذه الشركة بسبب إصابتي ببعض الأمراض الجسدية، لكن الشركة تطلب مني دفع تكاليف التأشيرة لإلغاء تأشيرتي.
ما هو التعويض الذي يجب علي دفعه للشركة؟
كيف يمكنني الاستقالة بشكل قانوني دون التعرض لفرض حرمان من خلال هذه الشركة؟

تغيير الوظيفة بعد المقابلة

س: عُرض عليّ وظيفة وأجريت مقابلة معي للحصول على وظيفة في مجال التسويق عبر الإنترنت في شركة في البر الرئيسي على أساس عقد محدد بموجب تأشيرة أمين مخزن.
بعد بضعة أشهر، يريدون مني أن أقوم بعمل مساعد ومنظف لأنه لا توجد مبيعات مستمرة عبر الإنترنت ولم أحصل على راتبي في الوقت المحدد. في كل مرة أحتاج أن أتوسل للحصول على راتبي في منتصف الشهر.
أود الآن أن أعرف ما هي العواقب القانونية التي سأواجهها إذا قمت بخرق العقد المحدد المدة (في عقدي تم ذكر ذلك في المادة 7) لأن ذلك يؤثر سلبًا على صحتي النفسية.

عندما انضممت، بدأوا يجبروني على أن أكون مصمم جرافيك. ظللت هادئًا وحاولت قصارى جهدي للتكيف لمدة أسبوعين. نظرًا لأنني لم أتمكن من التكيف، قلت للموارد البشرية إنني مصمم UX وأرغب في العمل على نفس الوظيفة.

Q: Hi,
I was reviewing my brother's documents to prepare the submission for verification of employment requirements in our country. I noticed that the designation in his visa and employment contract does not match.
He actually works as a video editor, but his visa lists his job as an "electrical equipment assembler," while his employment contract lists it as a "computer assembler."
How did this happen, and what problems might it cause in the future?
What actions should we take?
Our country requires an explanation letter from the company for such discrepancies.
What could be the reason for this discrepancy?

My employer fired me under Article 44 for not showing up for work for 7 days in a row. But that’s not the case at all. I was sick and the management was aware and they let me go.
I went to another country to get treatment because it’s expensive in Dubai. My employer did not pay me my salary for the month I worked and fired me.
I have official sick leave from another country and there is correspondence where my employer sent me to another country for treatment.
The problem is that the employer says that he will take compensation for the training that was specified in the contract, but I did not undergo training at all; I immediately started work from the first day of work and there was no training.
Does my employer have the right to charge me such a fee and not pay my salary?

How to cancel the MoU to buy an apartment with the broker if the bank did not approve the loan? 0
Hi,
I have a situation where I signed an MoU and gave my security deposit to the seller's agent. However later, the bank valuation of the property is lower than the selling price.
On my MoU, it has a clause that “the buyer has a right to cancel/negotiate if the bank valuation is not the same as MoU.” I tried to negotiate, however, we didn't agree on the price so I asked to cancel.
Now the agent is threatening me that they will not cancel the MoU and that will deposit my cheque. Later I also came to know that the person I am dealing with is not the same person whose name is mentioned as a broker in the MoU.
The agent I am dealing with is constantly messaging me with threats. I decided not to speak to him and instead, I wrote an email to the broker whose name is mentioned on the MoU but received no response.
I am on a very tight timeline as I need to vacate my apartment in 3 weeks, I found another unit but I don't know if I can pursue this while the initial MoU still not canceled.
Please, I need advice.
