تأخر تسليم الوحدة العقارية وحق الشاري

س: السلام عليكم اشتريت عقار قيد الإنشاء في دبي من إحدى الشركات وتم الاتفاق على الدفعات وقد دفعت ٨٠% من قيمة العقار والباقي عند التسليم. وقد تأخر تسليم المشروع أي أنه في مارس ٢٠١٩ يكون التأخير سنة وهو فترة السماح القصوى التي يحق للمطور أن يستغلها، ومن المتوقع أن يتاخر التسليم شهرين بعد موعد التسليم النهائي. يرجى المشورة بخصوص حقوقي بسبب هذا التأخير وهل يجب مراجعة دائرة الأراضي والاملاك لاتخاذ الإجراءات اللازمة مع المطور؟

Q: Dear Mr Hari, I would like to ask your advice. I have got a termination of my employment (unlimited contract) due to redundancy on September 2017 (a year ago). Since my son is under my sponsorship & studying in a Dubai school, I have requested to not cancel the visa until it expires itself. The company agreed to it due to the bad financial situation and inability to pay right away my "end of service" benefits. Every 2-3 months they were paying some amounts of the annual leave & annual tickets. My employment visa was cancelled completely in October 2018, and again due to bad financial situation the company was not able to pay the gratuity right away, so they provided the PDC.

رفع دعوى حضانة ونفقة على الزوج من خارج الإمارات

س: سلام عليكم. شخص لديه قضية مهمة جداً وأريد حلاً لها. لديه ابنة تزوجت في سوريا من شاب سوري مقيم في الإمارت. تزوجوا بسوريا وذهبت معه إلى دبي والآن لها ١٠ سنوات متزوجة ولديها ٣ بنات ٥ سنوات و٧و٩ وولد عمره سنة ونصف. قال لها زوجها سوف أذهب أنا وأنت إلى سوريا لمدة عشر أيام وندع الأطفال بدبي عند والدته. وعندما سافر ووصل إلى دمشق قال لها سوف أذهب مشوار وأنت اذهبي إلى بيت أهلك وأنا سوف أعود. وذهب ولم يعد. وبعد ٥ أيام تتفاجئ باتصال منه وطلقها وأخذ جوازها منها كي لاتعود إلى الإمارت. وبعد ٣ أيام يصل جواز سفرها والإقامه ملغية على جوازها. الآن ماذا تفعل بهذه الحالة؟ نريد الاولاد بالقانون وليس لنا أي أحد في دبي. أين نرفع قضية؟ جعلها الله في ميزان حسناتكم جميعاً

Q: I have been appointed as a POA holder on behalf of my boss/owner of my company to act on his behalf. He told us that he would help us in all financial aid from USA (where he is residing) and we just need to run the operations here in the UAE. However, it`s been quite a while where we have not received any support/financial assistance from him and there are a lot of unpaid bills pending here. I would like to know if I cancel my POA, can I get away with this mess or will I still be liable to pay and be penalized?

Civil and criminal case for cheque bounce

Q: My friend is in jail for a cheque bounce case. The criminal case is over and now they have filed a lawsuit in civil court for repayment of the disputed amount. 1) If I pay the amount in full in court on behalf of him, can he be released because the court has not passed any verdict against him in the civil case? 2) How much time will it take to get him out of jail after repayment of the money? Q: Hi, When signing the tenancy agreements, is it wise to give post-dated cheques for the quarterly payments in advance? Because from what I gather, when you issue a cheque you are bound to honour it although the contract is not fulfilled at a later part. Please advise. Thank you.

Q: A sales agent recently came into our house (around 7 pm) to do a demonstration on an expensive vacuum cleaner. After several hours, my friend and I decided to take 1 unit each because they have offered an instalment payment scheme for 18-24 months. The following morning at around 10 am, I tried to call the agent and sent him a message that I don`t want to proceed with the purchase as my husband did not agree to it. He is telling me that I can return the machine but I have to pay AED 4,000 contract cancellation fee, claiming that the machine has already been registered internationally under my name and the fee they are asking is for the cancellation. I did not even open the machine and notified him in less than 24 hours and now I have to pay AED 4,000. Is it right for them to write in the contract such terms on the cancellation? Also, they refused to take back the machine until I have given them full cheques for the AED 4,000 penalty. Thank you

Q: Hello, I am an Indian Hindu expat residing in the UAE since 2009-12 & 2013 till date and married since 2009. I hold an employment visa and not dependent on my husband.
