The consequences of working without a work permit
Q: An acquaintance of mine has been put in police custody as she was working in Dubai in a company that was involved in an employment fraud. She is on a visitor visa which is expiring in a few days. She has no money. The employer has fled the country. They are taking her to court & will provide legal aid. There are 3 more people like her from India - who have been caught in this. All of them were promised a working visa but were actually working on visitor visas. How long these cases last? How much you pay for bail? What will happen to her visa (she will have to stay till the case is finished - I guess)? What can she do in terms of documents, statements, affidavits to prove her innocence?

How to get maintenance from husband without divorce?
Q: Hello, I`m an Arab ex-pat living in the UAE my entire life. I have been married for 15 years. I have two boys and a good job, and I`ve been a good wife and mother. Unfortunately, my husband has left me for the past year and is staying with another woman. He sends me limited expenses and visits his children monthly. I`ve tried to reconcile with him but to no use. I have two questions: I prefer not to get a divorce as I yet have hope, but is there a way I can claim maintenance from him and how is this maintenance calculated? If I get a divorce, what happens to the custody of my children? Noting that they are both boys and the eldest is 14? My eldest is an autistic child who needs special support which his father can`t provide, and I`m deeply concerned if he requests custody of this child. Thank you!

Are wills made in India for Indian properties valid in the UAE?
Q: A will was made in India for an Indian property. The will states that "all other properties acquired hereafter should go to my wife". There was no will made in Dubai for the Dubai house. My husband (non-Muslim) passed away in Dubai. Can I apply this Indian will for a property in Dubai which was acquired by my husband before his death? Will the Sharia court accept this will or reject it saying that it is only for Indian properties? Are wills made in India for Indian properties valid in Dubai? Appreciate your answer in this regard!

Cancelling visa and claiming gratuity after forced COVID-19 leave
Q: Good afternoon. I am working in a nursery but since March we were forced to leave until September, and until now, we haven`t heard anything about reopening the nursery. We signed a formal forced leave without date until September. Now it`s December and we have not received any assistance from them. I wanted to go back to my country but they said I need to pay them. I want to take my gratuity and I was working with them for more than 5 years. This is my second 2 years contract with them. My contract will be over in October 2021. But I need to work for my family especially now in the COVID-19 situation. I need to have a new stable income. Please enlighten me what to do.

Termination of office lease before its expiry without paying penalty
Q: We have been using an office for rent in Al Karama since 2014 and renewed contract in August 2020. Now, since business is less we wanted to vacate the office because the rent was high and we informed the real estate office but they are saying we need to pay 2 months rent for free. Also, they are saying they will take AED 8500 old security deposit for damages and repair of office but there is no damage in office and it doesn`t even have any interiors or partition works done, just open office. Kindly advise if we have any rights to vacate without paying additional payments.
