هل يمكن نقل الكفالة بدون موافقة الكفيل
س: مرت سنتان ونصف بدون تجديد الإقامة وأرسلت خطابًا أنه في حال عدم تجديد الإقامة خلال شهرين، فسأتوقف عن العمل. اشتكيته فقال لي بالجلسة الأولى للصلح أنه ليس من حقي أن أتوقف عن العمل! هل هذا صحيح؟ رغم مرور سنتين ونصف وإذا كان ذلك صحيحًا، فهل يُسمَح لي بنقل الكفالة بدون موافقته؟ Questions & Answers

Cancelling visa and claiming gratuity after forced COVID-19 leave
Q: Good afternoon. I am working in a nursery but since March we were forced to leave until September, and until now, we haven`t heard anything about reopening the nursery. We signed a formal forced leave without date until September. Now it`s December and we have not received any assistance from them. I wanted to go back to my country but they said I need to pay them. I want to take my gratuity and I was working with them for more than 5 years. This is my second 2 years contract with them. My contract will be over in October 2021. Termination of office lease before its expiry without paying penalty
Q: We have been using an office for rent in Al Karama since 2014 and renewed contract in August 2020. Now, since business is less we wanted to vacate the office because the rent was high and we informed the real estate office but they are saying we need to pay 2 months rent for free. Also, they are saying they will take AED 8500 old security deposit for damages and repair of office but there is no damage in office and it doesn`t even have any interiors or partition works done, just open office. Terminating employees according to article 120 of the labor law
Q: Hello! My private LLC company terminated my limited contract with them effective immediately (without any notice at all) last Wednesday, December 2, 2020, under the grounds that I have violated section E of Article 120. Actually, they fired more or less than 13 people and most of us were about to finish our contracts January-April next year. As for me, my contract will end in February. The thing is, our employer told us all that no one of us will receive our gratuity because of their allegation that we violated section E of Article 120. The termination letters that they gave us have the heading of "Termination Notice" but on the body of the letter, it was written that our contracts with them were terminated on that day that we received them effective immediately. Also, the name of the HR manager was not signed and they just wrote the first name and the first capital letter of the surname like "John D." Please advise on how we should proceed. المطالبة بالتعويض بسبب تأخير تسليم البضاعة المتفق عليها
س: السلام عليكم، سؤالي هو أنني تعاقدت مع شركة لصنع الخزائن والأدراج بمبلغ 37800 درهم بتاريخ 17 يوليو 2020 وموعد التسليم 25 سبتمر 2020 حيث اتفقنا على تسليم دفعة أولى بمبلغ 4000 والباقي عدد 10 شيكات من 1 أغسطس إلى 1 يونيو 2021. لم يتم التسليم في الموعد المتفق عليه وصاحب الشركة يصرف الشيكات في مواعيدها الشهرية. أخذ صاحب الشركة يماطل ويعد بالتسليم دون جدوى. تقدمت للشرطة لفتح بلاغ فأعلموني بوجود بلاغات جنائية بحق الشخص ووجهوني لرفع دعوى نصب واحتيال. بالفعل بعد رفع الدعوى، تم فتح عريضة والقبض على الشخص، وبعد التحقيق أعطاه وكيل النيابة مهلة للتسليم والمهلة انتهت بتاريخ 26 نوفمبر 2020 ولم يتم التسليم! كيف أسترد حقي من هذا الشخص؟ وما تكلفة رفع الدعوى المدنية لفسخ العقد؟ وهل سأتمكن من المطالبة بتعويض؟ وما المبلغ الذي أستطيع طلبه؟ Questions & Answers

How to cancel the visa while the company delays cancelation and the employee is abroad
Q: Hi, I was working in a private clinic and I submitted my resignation through email and even informed the owner on WhatsApp and worked till the end of my notice period. I have asked my company to cancel my visa since the beginning of my last working week and have sent them repeated calls and even emailed them to cancel my visa. I told them that I will be leaving Dubai on 22/10/2020 so they should cancel my visa before that but they did not cancel my visa and they kept on delaying it. Now, I`ve left UAE and I still want to cancel my visa so the owner asked me to pay for visa cancellation on WhatsApp, my friend did and they have cancelled my labour contract however my visa is still not cancelled at GDRFA. I have repeatedly sent them messages on WhatsApp, phone calls and email asking them to cancel my visa before I leave UAE on 22/10/2020 but they ignored and did not cancel my visa. تطبيق قرار إداري بشأن مكافأة نهاية الخدمة بأثر رجعي
س: تحية عطرة، أنا إماراتي عملت سابقًا موظفًا في الحكومة الاتحادية واستقلت منها واستلمت مبلغا قدره (ثمانون ألف درهم) باعتباره مكافأة نهاية خدمتي. بعد أربع سنوات، رجعت إلى وظيفة لدى حكومة أبو ظبي، وقدمت طلبًا لضم خدمتي السابقة إلى خدمتي الحالية، وتمت الموافقة على طلب الضم على أن أسدد مبلغ الثمانين ألف درهم قيمة المكافأة الذي سبق أن استلمتها. مضت السنون (19 سنة) ولم أسدد المبلغ . وعندما أردت أخيرًا أن أسدد قيمة المكافأة، طلبوا مني سداد ما يقارب مبلغ المليون درهم، بذريعة أنه حدثت إعادة تقييم جديدة لطريقة حساب المعاش التقاعدي. السؤال: أليس القرار الذي صدر سابقًا بقبول ضم خدمتي وسداد مبلغ (الثمانين ألف درهم) هو الواجب التطبيق، كونه أصبح حقًا مكتسبًا لي لا ينبغي تعديله أو إلغاؤه، وعلى أساس مبدأ عدم رجعية القرار الإداري، وحفاظًا على استقرار الأوضاع للأشخاص وعدم تجاوز السلطات على بعضها البعض، وغير ذلك من الأسباب المتعلقة بأحكام وقواعد تطبيق القرارات الإدارية؟ ألتمس من أساتذتي الأفاضل الرد القانوني السليم مع جزيل شكري وتقديري! Reducing salary and leave encashment upon resignation due to COVID-19
Q: I worked in an LLC company for 1 year and 4 months. After completing one year, I haven’t taken any leave or encashment of my 30 days leave with full pay. During the Covid-19 pandemic, my employer reduced the salary without my approval, no contract was signed. There is no COVID impact in the client`s place where I am working. They did not reduce my contract with my company while the employer still reduces it for 6 months. I have resigned now. My employer dictates the amount on the final settlement. Indirectly, his saying is if you don’t take any leave, I will pay the full amount of your leaves and if you left the company, I will pay only basic salary.
