How to prepare a Will for non-Muslim in the UAE

I’m Christian and my husband is Muslim.

Can I still have a Will that allows me to choose who gets what if I pass away in the UAE, including the guardianship of my 3-year-old son?

You can make a Will, but legally your son's guardian is his father and he can decide on this.

You may contact me directly by phone or email for further consultation.

Hello,

Thank you for your question.

Generally, we always advise our clients to register Wills in the UAE, specifically if they are non-Muslim expatriates.

In the absence of a Will, the default application for estate distribution is the UAE inheritance laws, which are based on principles of Sharia law and jurisprudence.

This is also the case for other assets, including your bank account, which even if joint, may be frozen, without a Will. Similarly, if you and your spouse have children, default sharia guardianship will be applied.

Since you are not Muslim, then, legally, you can register a Will in the UAE. There are multiple Will options available in the UAE.
I also cover this topic on my legal podcast, LAWGICAL WITH LYLAW. This should be a good starting point for you. Here is a link to an episode on why it is important for non-Muslim expatriates to register a will.

Should you require further tailored substantive legal advice or assistance with your matter, kindly contact my firm at our email.

Kind regards,

Ludmila

Dear Client,

Good day!

Actually, as per Sharia, the property of a Muslim when he dies goes to Muslim.

So, if you are Christian, it's very difficult to get the Inheritance, however, according to the new change of law, things are still not clear which confirms that the law of the country where the person belongs will be implemented.

But the country which you belong to has Sharia for Muslim then I think the Will will not be effective because Sharia has its own way to distribute assets after death.

Thank you.
