How to sue a company for forging invoices to get a verdict against our company
Greetings!
A company filed a claim against our company for an unpaid invoice amount; they got an order from the primary court in Dubai against our company based on forged invoices.
1- We never received any summons/notice of the claim against us (neither from the court nor from the claimant), so we can file our reply/defence;
2- Once the court issued its order, we were served with the court order to pay the x amount; and
3- The claimant forged invoices (their receipt by our company by forging our employee's signature on such invoices).
Questions:
1- Is the lack of summons/notice a ground for appealing the court verdict?
2- Isn't forging someone's signature a criminal act under the UAE law?
Any advice will greatly be appreciated.
Thank you!
Dear Questioner,
Further to your above mentioned please check our comments below as follows:
1- if the claimant lacked to serve legal notice for your company with a period time of 5 days minimum, that means you have a great chance to appeal the court verdict against the company and we're pretty sure that the judgment will be in your company's favour.
2- Regarding forging the signature, if you succeed to prove that before the appeal court, that means you have an absolute legal right to sue the other company before the criminal court due to criminal offense and claim reasonable compensation.
In case you would like to approach our legal services please feel free to contact us on email.

Dear Client,
Good day!
It's an unfortunate situation, however, what you can do is you can prepare a forensic expert report from Court Listed Experts and then submit the report to the Public Prosecution or Police Station, file a criminal case against the people.
Also, you have the right to file a civil case asking for compensation for the amount of hours' loss, wasting the time... etc. You can file a compensation case against the parties on winning the criminal case.
For further assistance, please feel free to contact us by phone or send an email.
Thank you.
