دفع البائع رسوم الخدمات المستحقة على وحدة عقارية بعد بيعها

س: السلام عليكم، أنا بائع لوحدة عقارية وقد حدث نزاع بيني وبين المشتري منذ عدة سنوات، وأقمت دعوى عقارية لدى محاكم دبي، وفي خلال إجراءات المحكمة بجميع درجاتها كان المشتري يعيش في الفيلا وقد أقرّ بذلك أمام المحكمة، وفي النهاية صدر حكم نهائي بعد محكمة التمييز وقد تم الحكم بتحويل ملكية الفيلا إلى اسم المشتري. الآن وبعد كل تلك السنوات هناك رسوم خدمات تفرضها دائرة الأراضي والأملاك موجهة إلى اسمي حيث أن ملكية الوحدة ما زالت مُسجلة باسمي لدى الدائرة. السؤال هنا: هل يدفع المشتري رسوم الخدمات المستحقة أم لا؟ وشكرًا مقدمًا!

س: السلام عليكم، هل الحكم الغيابي بجنحة تبديد المنقولات وأنا خارج البلاد يتحول إلى حكم نهائي إذا لم يُتخَذ أي إجراء سواء معارضة أو استئناف؟ وهل يمكن ترحيل المحكوم عليه من الخارج بالحكم الابتدائي؟

How to get money from the employer failing to find assests in execution?

Q: Dear Lawyers, My dad had worked at a company for 33 years.Unfortunately, the company collapsed and he didn`t receive salary of previous 3 years and service money for past 33 years. He filed a case in labor and won the case in his favor. As his visa got expired, he gave fees for execution and left to home country. Now it`s two years and no money has been received. How can I move forward? When I inquired from the lawyer whom he had given the case, he said the defendant has transferred all his belongings to his children to show that he has no wealth. Any small piece of advice will be beneficial (Company is not a LLC).

س: السلام عليكم، قدمت استقالتي من خارج الدولة نظرًا لعدم قدرتي على الرجوع بعد وفاة والدتي وإجرائي جراحة. منذ شهر وأنا أطالب شركتي بمكافأة نهاية الخدمة؛ مرة يخبروني أنهم سيخصمون مديونية مستحقات زوجي من مستحقاتي، وإذا لم أوافق، فلن آخذ مستحقاتي، علمًا بأننا كنا نعمل في نفس الشركة. ومرة أخرى يخبروني أنهم لن يستطيعوا دفع المبلغ نقدًا، ومرة لن يستطيعوا تحويل مستحقاتي إلى حسابي البنكي في دولتي، ومرة لن يستطيعوا تحويل المبلغ إلى حسابي في الدولة. علمًا بأنني أخبرتهم أني فقدت كارت الفيزا الخاص بي، فيتعنتوا بأنهم سيحولون إلى هذا الحساب فقط وأنا أريد مستحقاتي على حسابي البنكي بدولتي نظرًا لعدم إمكانية الرجوع لإصدار كارت آخر في الوقت الحالي. ما الحل؟ يجبروني على الإمضاء على ورقة استلام المستحقات وورقة إلغاء الإقامة. ماذا أفعل؟

Q: I have lent money to my friend multiple times over the last year with cheques as a guarantee. I signed a tenancy contract and the landlord failed to finish renovation on time. What can I do?

Q: Good day. I have signed a tenancy agreement via agent for the townhouse to rent in Abu Dhabi on 24 June with a start date of rental on 1st July. Repairs/Repaint works from the previous tenant were yet to be completed by the landlord and are confirmed by the agent that will be finished in a few days` time. I have paid a deposit, agency fees, and 1st payment for 6 months. I received keys on 2nd July and found the rented unit without any significant repairs/repaints done. I returned the keys of the property on the same day to the agent and asked to contact the owner to correct all deficiencies prior to moving. I`m concerned that nothing will be done to resolve this issue promptly (I understand that the key is still not collected from the agent by the landlord so works have not been started yet). What can I do in this situation? What is the process if I want to terminate the contract and receive my money back for the deposit and 1 payment (as well as agency payments)? Thank you RG

What can I do if my tenant refuses to evict property at the end of the eviction notice?

Q: I purchased a property in Dec 2021. Transfer was in Jan 2021. The previous owner issued a 12 month eviction notice, dated 28 Oct 2021. On transfer, I met the tenant to get a new signed tenancy contract in my name with the same terms and conditions as pervious over, which expires in 27 July. In T&C`s, if he wanted to renew he needs to give 90 days notice, which he failed. At which point, in May, I emailed him to explain, and that he should vacate in 28 July 2022, he confirmed he got the email. We plan to move into our home. In the 1st of July he told me he will not move and filed a case at RDC against me. This case was rejected today, as he uploaded falsified documents for the case. Pervious to the case, I did offer to let him extend to Aug 30, an extra 4 weeks. Now where so I stand? As I would like him to leave asap, shall I open a case against him?

How can I claim the compensation mentioned in the SPA for delay in handover?

Q: I bought a property recently, the transfer is done in my name. But the previous owner still didn`t hand over the apartment to me. In the contract, it is mentioned that if the seller is not able to hand over the apartment on transfer, he is liable to pay compensation for the days he didn`t hand over the apartment. Q: Hello, We bought an off-plan apartment in 2006 in Sports City Dubai. It was supposed to be finished 2 years later. We have paid all monies to date as requested but not the final one as we haven`t been asked for it. We have had no notification from the company MED based in the Red Residence in Sports City. س: السلام عليكم، لدي مطالبة مالية بشيك مرتجع بقيمة ٥٠٠ ألف للزوجة، وأيضًا نفقة بعد الطلاق تُقدّر بـ ٤٠٠ ألف. كيف أقدِّم طلب تقسيط مبلغ المطالبتين حيث أنني لا أملك المبلغ بالكامل وأستطيع دفع مقدمًا بنسبة ٥٠% من مجموع المبلغ المطلوب؟ هل سيوافق القاضي أم اصطدم برفض طليقتي للتقسيط في محاولة منها لدخولي السجن؟ أم أن القاضي يرفض دخولي السجن ويوافق على التقسيط؟ وما أقصى سنوات للتقسيط؟ القضايا في محاكم دبي.

Q: Hi, I bought a property off-plan last year. The developer went bankrupt and the project was recently cancelled by RERA. We were refunded the deposit we paid. The estate agent that we used to purchase the place took commission (brokerage fee) of 40 000 dhs. They are now refusing to refund us, even though the project is cancelled. We never received an SPA or the house. The contract between us and the agency states end date is until transfer, that never happened. Is this legal?

How long should the eviction notice for personal use be served before eviction?

Q: Hi, I have sent an eviction notice to my tenant (as I plan to use the property for my own - 2BR in free zone Dubai) 4 months ago via Emirates Post registered email service (and I have got a digital certificate time stamped of receipt ). Is this accepted by the Dubai courts? My tenant is refusing to provide a tentative day to move out within the 12 months period from when I have sent the email, and says that according to RERA he will vacate the property only after 12 months since he received an ‘official notice of eviction’. The current tenancy contract expires in 2 months and I do not know what should I do if we do not reach an agreement. 1. Can I deny to sign a new contract upon expiration or I am obliged to do so, and if yes, for what period? 2. Should I send it through Notary Public or registered mail (courier with acknowledgment of receipt) a new eviction notice? That would mean that I acknowledge the previous one was void.
