س: السلام عليكم، هل توجد مهلة قانونية للمستأجر للبقاء بالعين المؤجرة لمدة بعد انتهاء مدة عقد الإيجار المذكورة بالعقد؟ لا يوجد اتفاق بين المؤجر والمستأجر على قيمة الأجرة الجديدة ويرغب المستأجر في البحث عن سكن آخر.

Can the landlord send eviction notice to the tenanct in the middle of tenancy contract?

Q: I have been served an eviction notice to vacate my home rental within 12 months.The notice receive 2 months after I renewed my 12 months contract. Is this legal? My understanding is that the eviction notice should be served upon expiry of contract and not after contract renewal. Appreciate the advise as I wish to stay longer in the same property. What is the best approach?

Can the landlord vacate us from the office without notice after paying pending rent?

Q: Last year was very difficult for the business as we really feel the effect of pandemic. Everything else was suffering and there’s the delay in salaries and some payables in the company and that include that office rent. We were being charged of AED 60k for 1 year, payable in 12 installments. At first, we were okay and paying it on time, but later on, although we were paying, it is getting delayed due to delay of receivables as well and with low cashflow. Tenancy: July 2021 to July 19, 2022 Recently, the company started recovering so all the pending dues for the office rent were paid before the end of tenancy contract. However, the landlord kept saying that we need to vacate the office as we are delaying the payment last couple of months. NO notice from his side thru email, no agency involved. He plans to increase the rent, I asked him how much is it but still wants us to evict us. I have two days more until the end of tenancy, does the landlord have the right to evict us?

I got a job offer and applied for visa but it got rejected due to security reasons

Q: I gave interview in the UAE and aslo got a job offer letter during my one month visit to the UAE, but my work visa got rejected due to security reasons. My first time I ever visited the UAE was that one month, and I don`t know what to do to make it proper.

How much time do I have to pay after the court issues a warrant to seize my assets?

Q: I have a cheque bounce case against me of 63830 Dhs and I paid 14000 out of this. I submitted a petition to get this money adjusted in the case balance. It was approved but the adjustment is not done yet. The other party`s attorney has meanwhile requested the court to seize bank accounts, RTA, DLD, Central Bank... etc. to recover the money. I have a travel ban also. I have 2 Queries - How much time do I get to make all payments after all the seize requests has been applied to court. I mean how soon do Banks, RTA, DLD departments reply to court? - Can I get arrested if Banks do not get money in my account? I am willing to settle out of court. But as 14,000 was paid in the party`s personal account, they did not acknowledge that in court despite I shared proof. So settlement if any, I want to do in court. Please suggest.

How to transfer salary to another bank after I signed an MoU to buy a property on mortgage?

Q: Hi, I have recently signed an MoU to buy a property and a bank has offered me a good loan package so I want to sign with them. Therefore, I have asked my employer to produce a Salary Transfer Letter (STL) to be able to sign my loan with this bank. Just to clarify, I have no loan with any bank, I just have a credit card with my current bank (never had any issue on it). To produce the STL my employer needs a non-objection letter (NOL) from my bank or a No Liability Letter (NLL). My current bank said the first option is impossible as "they do not have a template for that" and they can only produce a non-liability letter (NLL), however, this is not possible as it takes 45 days after card`s cancellation to get the NLL. My question is: Does my employer really need a NOL or NLL to be able to transfer my salary to another bank? (He never signed anything with my bank). Employer says there is a tacit agreement between employer and bank when the salary gets transfered to the bank, is that true?

How can a partner remove himself from a company?

Q: Hi, I have a business dispute with my partner in a civil company. My share in the company is 25%, partner`s share is 70%, and local share is 5%. I have an employee manager visa. Is it possible for my partner or the local to abscond or do any ban on me? And if the company visa is not renewed, would I get automatically canceled or not? Please let me know with your expertise!

الإجراء القانوني تجاه مستأجر قرر تسليم العقار قبل نهاية العقد

س: السلام عليكم، لدي شقة وعقدها سنوي مع المستأجرة وتم تأجير العقار السنوي. أرسلت المستأجرة رسالة بعد أقل من شهرين أنها ستُسلم العقار نهاية الشهر الثالث لشرائها شقة وبالتالي تخلفت عن سداد باقي الإيجار (9) أشهر ولم تلتزم بفترة الإنذار وهي 3 أشهر قبل نهاية العقد. ما الإجراء القانوني؟ وهل يؤثر رفع قضية وتأجير الشقة للغير على الحكم؟ أرجو الإفادة!
