س: السلام عليكم ورحمة الله وبركاته، كنت محتاج استشارة قانونية. سأشتري شقة في منطقة الإسكان الاجتماعي والشقة عليها حظر. سنحرر توكيلاً موثقًا في الشهر العقاري بالبيع وإتمام عمليه التنازل بعد مدة الحظر. أريد أن أعرف مدى قانونية التوكيل. وهل سأتمكن من نقل الملكية بعد مدة الحظر بسهولة؟ وشكرًا!

تمكين المستأجر إيجار قديم من تغيير البلاط وإدخال منقولات

س: السلام عليكم، أنا مستأجر إيجار قديم. المالك رفع دعوى إخلاء لعدم الامتداد ورُفِضت الدعوى أول درجة وهي الآن في الاستئناف. المالك منعني بالقوة من تغيير البلاط وبعدها منعني بالقوة من إدخال بعض المنقولات إلى شقتي. طلبت النجدة ولم تفعل شيئًا وهددوني بحجزي. لم يتم عمل محضر لأن المالك محامى وله معارف. هل يمكنني رفع دعوى تمكين من تغيير البلاط وإدخال بعض المنقولات؟ وإذا كانت هذه الدعوى لا تجوز، فما الحل؟

After signing the offer letter and the contract, the employer cancels the contract

Q: Hello, I am an American expatriate who was offered a job in a Dubai school. The employment offer and contract were both signed. The school asked me to come to Dubai on a visit visa and said they will process a work visa once I arrive. I arrived at their provided accommodation, but 2 days later, they canceled my contract stating I am no longer needed because of the low number of students in the class. They are now asking me to move out of the apartment in 1 day and go back which is all against the contract. I contacted MOHRE but they said that a case cannot be filed because the school did not start the visa process. What are my options here? I am left with no work, no housing, and still not compensated for even the air ticket here which was all promised to me. Surely, the signed offer letter and the contract from both parties has some legal standing. I am willing to prolong my stay to take this school to court. Please help. Thank you!

How can a sleeping partner recover his benefits as an employee?

Q: Dear sir/madam, I am a sleeping partner in a private LLC company in Dubai. I am paid a salary monthly. I am in the process of resigning from the company. However, the Indian partner is not willing to give me end-of-service benefits as per the labor contract. He wants to reduce the benefit amount. الكفيل ألغى التوكيل الضد ويريد الاستيلاء على الشركة. ما الحل؟

تقديم شكوى ضد بائع سيارة مستعملة بسبب وجود عيوب فيها

س: السلام عليكم، اشتريت سيارة مستعملة من أحد المعارض في سوق الحراج وبعد نقلها أصلحت الأشياء البسيطة ولكنني اكتشفت بعد عدة أيام وجود مشكلة في المحرك. قيمة تصليحها 6000 درهم. أرسلت المشاكل للبائع ولكنه لم يعد يجيب على هاتفي أو رسائلي. ماذا يمكنني أن أفعل؟ هل يحق لي تقديم شكوى ضده بسبب بيعه سيارة بها عيوب؟ وشكرًا!

Can a bank file a case for a bounced cheque in other GCC countries?

Q: Dear sir/madam, I have unpaid debts in the UAE for bounced check + credit card of 150000 AED. This bank filed a criminal (or police) case and most recently, a civil case against me in the UAE. Now, I am trying to get a job in one of the GCC countries to be able to pay for the first payment (50% of the debts, and the others as instalments, since this bank refused any other payment ways). I know that the bank has branches in the GCC countries. Can this bank, at any time he wishes, share my case information with one or all his branches in GCC countries so they can file cases against me there as well? Thanks!

The judgment of the first instance court is in favor of the employee. What to do upon appeal?

Q: Dear Lawyers, I would like to bring to your kind attention that a month back, I won a case against my employer (the case is rejected by the court) of AED 90,000. After 10 days of the first instance decision, my employer filed an appeal. The court has given the first hearing date of appeal. My question is: can the judge dismiss his appeal after the first hearing as his appeal is based on some ridiculous charges against me?
