س: لدينا أرض (ورثة من الجد) مكتوبة باسم أحد أعمامي، والآن مع مرض والدي طالبنا بنقل ملكية الأرض لنا. أبلغنا عمي أننا يجب أن ندفع حوالي 50 ألف دينار لفرز الأراضي ووضع إحدى الأراضي للبيع من فترة طويلة، وعلى هذا الأساس نبيع الارض ومن ثمنها نفرز باقي الأراضي. ولان الوضع خطير ومستعجل كون الحياة ليس فيها أمان، وأيضاً موضوع بيع الأرض طال انتظاره، أتانا أحد المقربين بفكرة رهن الأراضي. يعني أن نطلب من عمي أن يعطينا الأراضي كرهن، وعندها تصبح حرية التصرف بالأراضي لنا. هل هذا الكلام صحيح؟ هل إذا ذهبنا إلى المحكمة وسجل لنا عمي رهن بالأراضي تصبح حرية التصرف كاملة لنا من بيع أو فرز؟ وماهي عواقب الرهن من ناحية الطرفين؟ أتمنى الرد بأسرع وقت ممكن وأكون لكم من الشاكرين.

متابعة قضية امتناع عن توزيع أرباح مشروع تجاري

س: أنا مستثمر ودفعت مليون ونصف درهم لصاحب شركة أردني بصفته المدير التنفيذي للشركة. تعاقدنا على استيراد 3 ألعاب من خارج الدولة في أواخر سنه 2013 وهناك خلافات بشأن الأرباح. ينص العقد بدفع أرباحي كل ستة أشهر بموجب شيكات، وكل مرة يعدني بأن يعطيني شيكات إلى يومك هذا. رفعت عليه قضية وأحالها القاضي للخبير المحاسبي، وللأسف لم ينصفني ابداً. للعلم، بعد التعاقد ب 7 أشهر وقعت على ملحق اتفاقيه أن الأرباح مناصفة ولكنه خدعني بكلمة (الأرباح التشغيلية) بما معناه أنني سوف أتحمل كل المصاريف الإدارية معه ووقعتها بحسن نية. الشخص موجود داخل الدولة ويصر أن لا يعطيني حتى شيكات ضمان، مع العلم أننا قمنا بتوقيع الاتفاقيه في مكتب المحامي ووقع إيصال على استلام المبلغ كامل باسم الشركة. والقاضي رفض إصدار منع سفر لأن الشركة فيها شريك مواطن ليس له علم بالموضوع ولا يستطيع أن يمنعه أيضاً من السفر. هل أستطيع منعه من السفر والذهاب الى قاضي الأمور المستعجلة لأنه يرفض أن يعطيني حتى شيكات، وإلى اليوم لم يسلمني درهماً واحداً مع العلم ان الألعاب شغالة ولها دخل ضعيف ولا يرضيني. كيف أقنع القاضي أن يمنع الشخص نفسه وليس الشركة من السفر خوفاً من الهروب؟

طلب مهلة لتسديد مستحقات البنك لحين البت بقضية عمالية

س: تم إنهاء خدماتي في مطلع العام الحالي من قبل الشركة التي أعمل بها بحجة المادة 120 من قانون العمل لأني أتأخر في القدوم للعمل، ومن دون إنذار خطي مسبق. الآن لدي قرض شخصي في البنك وقرض سيارة وفيزا كارد. رفعت على الشركة قضية عمالية لتحصيل مستحقاتي لكن البنك يتوعد بفتح بلاغ للتأخر بتسديد بعض الأقساط. ما الحل وهل أستطيع أن أسبقهم وأرفع دعوى في المحكمة بعد الحكم لي بمستحقاتي لدفع المبالغ الأساسية التي أخذتها من غير الفوائد والغرامات؟ أفيدونا جزاكم الله خيراً

Ensuring the delayed second payment of a bounced cheque by defaulter

Q: I hold a bounced cheque with the amount of AED 400,000 against the defaulter, that bounced in December 2017. A police case filed the police station. The defaulter has my account number and made a cash payment of AED 202,000 into my account, thereby having a proof of the money deposited in my account. The total amount currently owing is AED 198,000. The question is: Since the amount currently owing is AED 198,000, can I still proceed with a civil case against him? I have not given any clearance, nor have I accepted any further cheques from him yet. The defaulter promises to pay the remainder of AED 198,000 by July 2018. I think defaulter is trying to play a tactic so that he doesn`t pay up the full amount. Can anyone shed any light on this area? Is there any way I can get a court order or a legal document signed by him and myself, along with a lawyer or witness, stating that he will have to pay AED 198,000 as promised by him? In case he decides not to pay, can I use that document in the court? Thanks

س: سؤالي يتعلق بخصوص وكالة محامي. فقد صدر حكم من محكمة الاستئناف أقرت فيه كالتالي: تعتبر وكالة المحامي غير صحيحة وفقا للماده رقم 834، حيث أن الموكل به يجب أن يكون معلوماً، وحيث أن الموكل به لم يكن معلوماً، أصبحت الوكالة غير صحيحة. ولكن هناك قضية أخرى نفس معطيات القضية الأولى وكان الحكم ضد المدعي عليه مع العلم أن وكالة المحامي غير صحيحة ترتب عليه ضرر واقع على المدعي عليه وأصبح القرار قطعي. ملاحظة: الموكل قام بتوقيع الوكالة فارغة وسافر خارج المملكة. قام الوكيل ( المحامي ) بتعبئة الوكالة لاحقاً وقام باستخدامها في المحاكم، مع العلم أن الموكل به لم يكن معلوماً. هل يعتبر ذلك تزويراً يستوجب اللجوء الى المدعي العام أم هو خطا مسلكي؟
