The time frame for the execution of a labour judgement in case of appeal

Q: I have won a case in Dubai labour court against my employer. The court has given the verdict in my favour and ordered the company to pay me AED 75,000 with a return ticket. But my employer has filed a complaint against the verdict in the appeal court. My questions are, How much time will it take? What documents do I have to provide? When can I get my dues? Please reply to me. I`m sitting jobless at my room, with no money from the last 6 months. I`m in great trouble. Please reply ASAP. Best regards

استرداد الأموال المدفوعة قبل انتهاء دعوى احتيال وتزوير

س: تم رفع دعوى احتيال وتزوير وإساءة أمانة قبل 3 أشهر ضدي لدى محكمة صلح جزاء، وقام والدي دون معرفة أي تفاصيل بدفع مبلغ 50 ألف دينار للمشتكي لإسقاط حقه الشخصي قبل الدخول على المدعي العام وقبل ان يتواصل معي، حيث تم الإقرار بالتهمة البالغة 37 ألف دينار أمام الادعاء العام من قبلي. ولم ألتقي بالوالد قبل دفعه المبلغ، وبعدها قرر المدعي العام تركي وشأني واستمرت الدعوى في القضاء للحق العام وما زالت منظورة حتى تاريخه لأنني قمت بتغيير أقوالي لدى القاضي ولم أقر بأنني مذنب. وما زالت القضية منظورة وصدر العفو العام بتاريخ 13/12/2018 ، واتضح لي ولأبي وللمحامي أن المدعي قد استلم مبلغ 13 ألف دينار زيادة عن المبلغ موضوع الدعوى المسلم به. وتمت المطالبة بالمبلغ إلا أنه رفض ذلك قطعياً بانتظار كلمة القضاء، حيث علمت بان القضية ستوقف كونها تتعلق بحق عام والمشتكي أسقط حقه أمام القضاء. هل يستطيع الوالد استرداد أمواله كاملة كونه تعرض لابتزاز، علماً بان الدعوى مشمولة في العفو العام؟ وهل يستطيع المدعي حبسي في حال تم الرجوع إلي؟ وهل يستطيع الوالد استرداد أمواله كاملة كونه دفعها من أمواله الشخصية ويستطيع اثبات ذلك؟

Renewal of a partner's visa to avoid the loss of partnership

Q: A company has two partners P1 & P2, and P2 partner`s visa expired. In order to give the complete ownership to P1, P1 is hesitating to provide the money for the share by giving excuses of liabilities. P1 owns 75% share and P2 owns 25% legally approved by the government, but with an understanding between the partners, they came up with another contract by P2 having only 10% with no liability. The only issue is that this contract is not government approved, is it still valid? Now, P1 is trying to acquire the whole company by not allowing P2 to renew the visa. What should be done? Q: Dear Sir, We are a manufacturer of hotel supply product which locates in Bangkok, Thailand. We did export to a company in Dubai and allowed them to clear custom already. However, they have not paid to us for a total amount of USD 46,369.16 until now. They are SME Award company and they are a member of Chamber. We asked our Thai Consulate to call them. They still refuse to pay. We would like to hire a collection agency in Dubai, but we worried that if we pay upfront for issuing a legal notice, we still don’t get money. Please advise if we should sue through the chamber or appoint a collection agency. If we appoint a collection agency, how can we make sure that we will get money back after paying an upfront fee?

Forcing more payments after clearing a bounced rental cheque

Q: Assalamu Alaikum Dear Ma`am. I was charged in a cheque bounce case in October 2018, due to a failure of the rent payment through cheque. The cheque amount was AED 14000. I was summoned only once by the court and was given a fixed time to pay the dues and vacate the house. I have paid all the due rent (Approx AED 17000) last week. The real estate agency`s lawyer is not closing my case, forcing to pay first case amount and some overstayed rent. Today he said: you have only one-day time to pay court charges and case fees, and overstayed rent, otherwise tomorrow Baladiya will come and throw you out. Is it possible? Please give me guidance as to when my case will be closed. What is the rule of Baladiya in this case? And is it connected to the renewal of tenancy? Can I renew my Tenancy contract or not? العفو العام في دعوى جزائية بخصوص إساءة أمانة

س: هل يشمل العفو العام الذي صدر بتاريخ 13/12/2018 في الأردن دعوى في محكمة صلح جزاء بإساءة الأمانة المشددة والتي فصلت من المدعي العام ومنظورة في القضاء بتاريخ 1/12/2018؟ علماً أنه لم تحصل أي جلسة لدى القضاء بعد، هل في حال ثبوتها سيتم سجن المدعي عليه أم ستعامل معاملة المطالبة المالية في إجراءاتها؟

Q: I have signed a security cheque for a car loan on behalf of POA General of a company. Now, I have left the company one year ago and the POA is not valid.
