Penalty for early termination of the lease contract
Q: I have a studio in discovery gardens. I have taken it on 4 cheques. My 3rd cheque is from this month, mid of April until mid of July. I have been transferred to Amsterdam and need to report on duty from June. I have informed the real estate for early termination. They told me that beside this cheque, I need to pay 2 months rent plus 1000 penalty. Can you advise how much do I have to pay for early termination as per the law?

The legal way of disputing an order from the court of appeal
Q: Hi Dr Amira, I am a Hindu Indian expat living in the UAE. My husband and I have legal cases going on in India and we are living separately in the UAE. My husband filed disobedience case against me here and I won the case in the Court of First Instance, but he filed an appeal and he won it in the Appeal Court. The judgement says I did not provide enough evidence, while I have provided all attested court documents from India. How can I get the court to re-look at the documents? Until when do I have time to file the appeal? I used legal support from a law firm but they have not helped much. Can you let me know how I can get the court to re-look at the documents, please?

Avoiding a case or travel ban for unpaid house rent
Q: Dear Dr Amira, I have a legal case against me for unpaid house rent in Abu Dhabi. I am not sure what to do, shall I go to the judge and ask him to pay a downpayment? Or shall I go to the property owner to make a settlement? My only concern is that I don`t want to have a travel ban. I have started a new job and it requires me to travel to Oman. Suing the developer for refusing to hand over the property
Q: Dear, I bought an off-plan property from a developer in 2007 for which I have an Initial Contract of Sale with the Dubai Land Department (Contract no: ------------). As per the Dubai Land Department (in writing) they mentioned that by now, the project is finished and I should have been issued the title deed which is already registered under my name. However, the developer claims (verbally, not in writing) that the project was cancelled. The developer now proposes (verbally, not in writing) to refund my money rather than hand over the apartment. I believe what happened is that after we signed the contract, the developer decided to change their plans and re-sell my apartment to another buyer for a higher price without my approval. I want the developer to honour the contract or compensate me in line with the current value of the apartment I bought. It is being sold currently at a 70% premium compared to when I bought it. The Land Department suggested to take up this issue with the Dubai Courts.Apr 8, 2019

Closure of bank cases for defaulting on loan and credit card
Q: hi Sir, My name is A. P. and I was working in the UAE from 2006 to 2010. During my stay, I had two loans (Personal & Vehicle) with a Dubai bank using two different credit cards with two other banks. Due to huge family and financial issues, I was forced to move back to India. But before my return, I have closed my both loans in Dubai bank (Personal and Vehicle). To be very honest with you, that time I was not in a position to close the credit card debts and later, I was in a position to contact them and pay. I have never tried to come to Dubai in fear of blacklisting through immigration or other litigations. If you can, please do let me know how to close those cases and the possibilities to enter Dubai again. Note: I don`t even remember my card numbers but I can give the bank name. Looking forward to hearing from you soon.
