Proving the actual amount in a bank case for a personal loan

Q: Dear Madam, I took a personal loan from a bank for AED162,000/- and paid AED 139,000/-. Now, the balance is 84,000/- (with interest). I received information that the bank has filed a case for AED 219,000/-. I did not pay the monthly EMI of AED 4,538/- for more than 6 months due to job loss. How is the bank filing a case for 219,000/- instead of the actual amount? What is the procedure to reply to the bank against this case? Please advise. Thanks and regards, S.

Consequences of defaulting on the payment of loan EMIs

Q: I have a personal loan with a bank amounting to approx. 180000 (Principal) post deduction from my end of service benefits. I was terminated from work on 10 Sept 2018. Right now I am in India. My first EMI got bounced on Feb 2019. Please help me know what is the maximum punishment by the court in such a case. As of now, I am jobless. If I come to Dubai to search for work, will there be a travel ban to exit from the UAE? How can I extend my stay in Dubai as I will enter the UAE on a visit visa? Can a settlement be through the insurance company as I was terminated by the company? As of now, there`s almost no chance to get any work in the UAE. Hence I am bankrupt. What I can do in such a case? Will I be able to work in the UAE and get a work visa if a case is registered?

Possible punishment in a complaint for bounced cheques

Q: My husband is an investor and I am a housewife in the UAE. My situation is that my husband had attempted to buy several properties in Dubai on my name. However, over the past months, he has been seriously ill and hospitalized multiple times. Eventually, the MOUs of these properties expired before we were able to take ownership transfer, and the sellers placed the 10% deposit cheques in their accounts. These cheques bounced because my husband was unable to arrange the 10% deposit amounts in time due to his illness. Now, these sellers are making a police complaint against my husband and are threatening to put him jail. They have been unwilling to show any mercy despite his medical records, and the doctor’s official recommendation that my husband should rest for a month. Please note that our MOU was a basic one, and had no clause that excuses ill health.

The commencement date of a limited labour contract to be considered

Q: Sir, I am on a limited contract working for a company in Dubai. I have a problem getting the exact date of my contract completion. I want to know from which date the contract period starts. It is mentioned in my visa 22/03/17 and ending on 21/03/19. But in my signed contract paper it is mentioned as "it is on wednesday corresponding to 08/02/2017 in the UAE." I would like to know the ending date. Also, do I have to serve for another month after this period if the company makes me do?

Arbitrary dismissal and basis for the calculation of gratuity

Q: Good afternoon, I have been working in a private firm for the last 13 years in an unlimited contract. Now, I have been terminated as per their part of downsizing. My notice period would complete by the end of April. Since 2006, I`m working in the same company, starting my salary was 3500 and my basic was 2500 then upon increments they added all the increments in others category. They never changed the basic from 2500 and now my salary is 12000. In 2017, they forced me to change my visa from the branch to head office license due to the branch license closure, and that time, they needed to change my basic as per my salary so they put 7500 as my basic. During that of renewal, I signed a new employment contract mentioning the new basic, I have the document with me as well. My question is, am I eligible for 3 months` salary and whether these 3 months include the notice period or apart from that is 3 months? Will my gratuity be calculated based on the new basic or old basic salary? Thank you.
