Are the execution court procedures effective?

I filed a civil case 2 and half years ago and we had a settlement in court. The person issued new cheques for payment but now all his cheques bounced and there is no more intention to pay.

I went back to the court and they told me to proceed with the execution. The amount is only 40k and the person just paid 8k since 2016.

I haven't collected my money yet and now I have to undergo again a process in the court and I'm just afraid that I will pay court fees again and it will not be guaranteed that I will be able to collect the money.

Please advise.

Thanks for your inquiry.

Having said that you have a court judgement in your favour and the defendant have not paid you the full amount, you are entitled to register an execution file.

The execution court will notify the defendant in all possible means and ask them to comply with the court judgement.

After the notification period (15 days), and if the defendant did not pay his dues, the execution court has the powers to take different steps to collect the debt (e.g. attachment orders on movable and non-movable assets).

The execution court fees depend on the case type and the applicant type.
