وجوب شهر عرائض الدعاوى الواردة على عقارات مسجلة

س: اشتريت 53 مترًا من أصل مساحة 318 متر فى 2009 بموجب عقد ابتدائي، وعملت صحة توقيع لهذا العقد. فوجئت أن البائع فى 2013 قام ببيع كامل مساحة الأرض ومن ضمنها ملكي فقمت برفع دعوى استحقاق الضمان وأحيلت الدعوى للخبير لتقدير ثمن الأرض وانتهى الخبير من وضع تقريره، وحدد الثمن ولم تحدد جلسة فى المحكمة لمناقشة تقرير الخبير والمذكرات النهائية. سؤالي هو: هل يجب أن أشهر عريضة (صحيفة) الدعوى في هذه الدعوى التي رفعتها؟ أنا خائفة من رفض الدعوى. أنا من مصر.

Forcing an employee to pay visa costs in case of resignation before visa expiration

Q: Hi, In my offer letter, which I signed, it is written that the visa cost of AED 5000 will be incurred if the employee leaves before visa expiration. After 6 months, I have given resignation with two months’ notice period according to my unlimited term employment contract. Do I have to give AED 5000 as a visa penalty? My boss says that he won’t accept my resignation until I pay the company 5000 AED. It has been 16 days since he didn`t accept my resignation. He is forcing me to give 5000 AED and threatened to ban me if I do not pay. Can I go to MOHRE? If I launch a complaint to MOHRE and the matter is still not resolved and it is referred to the court, do I have to hire a lawyer then?

The responsibility for maintenance of a flat damaged by a leak from another flat

Q: I`ve been having issues with my building management regarding a supposed leak from my flat damaging another property. I`ve contacted Rera with the following: My building management is saying that there is a leak coming from my bathroom drain pipe which is damaging the below apartment. There is no leak inside my apartment. The only way to access the leak is to go through the below apartment`s false ceiling as there is no possible way to access the drain pipe from my own apartment. My building contract also does not mention anywhere that I would be responsible for paying for this kind of damage. I would like clarification on who is responsible! Also, the time that the leak was reported the flat was unoccupied. Rera has replied that I am not responsible, however, the management company is still insisting. Any ideas?

Premature termination of a tenancy contract by a tenant due to an emergency

Q: My landlord/agency may be filing a case against me in court over a rental contract. I broke my contract as I lost my job. He has 2 cheques with him, however, I gave him 2 months` written notice on emergency grounds as I lost my job and visa. He insists that I should pay 1 or 2 months penalty fee. الزيادة السنوية في عقود الإيجار

س: السلام عليكم ورحمة الله وبركاته، كل الشكر والتقدير لكل القائمين على الموقع الرائع والمفيد واسمحوا لي بالسؤال وأتمنى الرد عليه. أود أن استأجر مجمعًا تجاريًا وعمارة سكنية. يحتوي المجمع على محلات تجارية ومكاتب وأغلبه يحتوي علي وحدات سكنية بضمان تقديري 40 ألف دينار وتدفع مقدمًا نقدًا، وسيكون العقد لمدة خمس سنوات. تم الاتفاق على كل شيء، ولكن مالك العقار يطلب زياده سنويه 5٪ والاختلاف على هذه النقطة. هل الزيادة تكون عند تجديد كل عقد أم تكون عند بداية كل سنة عند دفع الإيجار المقدم؟

Proceeding with a labor case after getting a judgment while the sponsor is abroad

Q: Good afternoon all, I opened a labor court case because the company fired me and didn`t pay my settlement or my salaries which are more than 4 months. I have already got a judgment that my sponsor has to pay me. Apparently, he is not in the UAE as his business is in Pune and Mumbai. Also, he did not appear in any of the court hearings. Now, the AI Adheed told me: 1) That I have 45 days to proceed with the cancellation of my Visa and labor card or I will be banned. Is this true? The Visa isn`t valid until the end of the next year and honestly, I would like to take it with me to be able to get a new job in the UAE. 2) I have to proceed with the execution to be sure that the company will pay me. Please assist me, how should I proceed?

مطالبة المستأجر بقيمة إيجار سنتين رغم عدم استخدامه للشقة خلال تلك الفترة

س: السلام عليكم، لدي استشارة قانونية بخصوص إيجار شقة. استأجرت شقة من مالك بناية بعقد لمدة سنة ولم أستطع الوفاء بآخر دفعة وارتد الشيك الخاص بها. طلبت من الشركة المسؤولة عن إيجار الشقة تقسيط الشيك وأبقى في الشقة، رفضت وطلبت مني إخلاء الشقة بدون أخذ أي أغراض منها. أخذت الملابس والأشياء الضرورية وبقيت جميع الأغراض في الشقة. أخبروني أني أستطيع أخذ الأغراض في حال سداد قيمة الشيك. حصلت ظروف واستمر الحال لأكثر من سنة ولم يتصل بي أي شخص من قبل الشركة إلا بعد سنتين تقريبًا بحجة عدم مقدرتهم على التواصل معي. الآن يطالبونني بسداد قيمة الإيجار عن سنتين! علمًا بأنني لم أسكن في الشقة طيلة هذه الفترة. ما الحل؟ لدي ما يثبت أنني لم أشغل الشقة؛ مثل فاتورة الكهرباء التي لا يوجد فيها أي مبلغ لأنها لم تستخدم منذ ذلك الوقت. طلب مني المكتب إخلاء الشقة من الأغراض، ولكني أخشى حين أخلي الشقة الآن أن يكون ذلك بمثابة إثبات أني كنت أستخدمها! أفيدوني باستشارتكم. لكم مني جزيل الشكر!

مسؤولية التعويض في حالة وقوع حادث بسيارة الغير

س: أعرت سيارتي لشخص ليقودها ووقع حادث. اكتشفت الشرطة أنه كان مخمورًا. تسبب الحادث في إصابات وأضرار. أصحاب الإصابات رفعوا الآن دعوى مدنية للمطالبة بالتعويض. على مَن تقع مسؤولية التعويض؟ على المتسبب في الحادث أم الـمالك أم شركة التأمين حسب القانون الإماراتي؟

س: ينتهي عقد الإيجار لشقة في دبي بتاريخ 14 أغسطس 2020 إلا أن المستأجر طلب إنهاء العقد مبكرًا ودفع باقي مبلغ العقد له مع مبلغ التأمين 5%. السؤال: هل يتوجب على المالك قبول فسخ العقد وإرجاع المتبقي؟ مع التقدير!
