Holding labour entitlements for losing the money of a client

Q: I have been working in an organization for 29 years and have been giving them fairly good business with profit. In 2018, one of my customers absconded with materials worth AED 500,000. I had collected cheques and all other documents from them. I also lodged a police complaint. He could not be traced nor is our material returned. Recently, I wanted to retire and go back home. But my employer refused to give my incentive since 2017 and my end of service benefits. How do I deal with him?

Claiming compensation due to delaying salary for over 4 months

Q: Hello, I`m in a situation when my employer didn`t pay me a salary for over 4 months. I filed a complaint against him in MOHRE and the case has already been moved to the court. While I was working unpaid. I had to use a credit line from my home country to cover my living expenses. It would be right to say that the quality of life was deeply decreased, plus now I owe money to a bank in my home country. Is there any way I can claim compensation for that, together with compensation for the moral damage caused by working unpaid? Guide me, please. Thank you!

Resigning and claiming labour dues after signing the cancellation paper

Q: Hi I need your advice, please. I resigned and completed my notice period upon transferring my visa from DMCC to TECOM. My employer sent the end of service settlement along with my last salary and leave benefit. Now, to complete the process, they need me to sign that I have received the amount which I didn`t. My previous employer is saying they don`t have money right now and to sign then they will pay once available. My question here is that if I sign, do I lose my right to claim the money if they didn`t pay? If yes, what kind of legal document or cheque can I ask them to provide prior signing? I`m hugely affected as I can`t transfer the visa. I have asked DMCC and they said I can file a complaint for them to try to settle but I`m sure my previous employer will come and say no money without solid commitment to pay. Then DMCC will advise going to court which might take a long time. I don`t like to make problems but I need advice on what I can ask them to provide to secure my money and to transfer my visa.

Early exit of rent and penalty payable to the landlord

Q: Hi I am a tenant in Abu Dhabi. I have been staying in the same apartment, for the last 6 years. I had given 2 months notice to vacate the apartment in case the rent is not reduced. But the landlord did not reduce my rent. Unfortunately, I am not able to move to another apartment, within the notice period. So I asked him for an extension of 10 days, or for 4 months since I will be moving to Dubai within 4 months as my husband is working in Dubai. But he refused to give any extension. Now, what are my rights in case of early termination, he is telling that I am supposed to give him 2 months notice, and after completion of 2 months notice, I am liable to pay him another 2 months rent. Please advise what are my rights under this.

Claiming back money paid for investment after breaching obligations

Q: Before 2 years, I gave a loan to the owner of an advertising company. He was getting an order of advertising on a 2-3 month credit basis. However, he did not have the cash amount to pay the suppliers; hence, I gave him a loan against a share of transaction profit. Against my cash cheque, he was giving me 2-3 month post-dated cheque for the amount value of cash paid + the profit. Things went well until the very last cheque bounced with an amount value of AED 80,000. Further, I gave the same owner but under a different company (gym business) AED 100,000 to purchase new gym equipment. He gives me rent of 3K per month until 6 months and after that, he pays me 114K to own the gym equipment. Only 2 x 3K cheque cleared but the rest bounced. Now, I`m left with 80K cheque from the advertising company, 3 x 3K from the gym company, 100K from the gym company, 14K from the gym company. Can I legally proceed and successfully get my money back? What are the procedures and how much will it cost? Thanks

Q: Dear Sir/Ma`am, I`m a resident of Singapore holding an Indian passport and just a job offer from a company called [--------] in Dubai. In the offer, they`ve mentioned: "Newly recruited foreign expatriate employees to join our team are bound to process & obtain 3-year valid U.A.E Residence Visa & Work Permit before joining with our work team on the resumption date. U.A.E Residence Visa and Work Permit are valid only for 3 years (renewable) for employees in Free Zone. Any Employee who accepts this offer shall contact this Logistics Agency [--------] travel agency & pay all expenses for processing, procurement & acquisition of their UAE Residence Visa & work permit`s clearance papers from Ministry of Interior. The employer shall reimburse all expenses upon employee arrival in the UAE." Is it ok if I pay all the expenses for the UAE Residence Visa/Work permits? I thought normally Dubai firm shall bear visa expenses. Thanks

س: هل يمكن إزالة الحرمان الدائم؟ صدر ضدي حرمان دائم بسبب هروب من الكفيل منذ عام 2014. وقبل المغادرة في بداية 2018، قدمت طلب استرحام للجوازات بمرافقة القنصل المغربي، وأُخِذت بصمة العين ومُنحت تصريح مغادرة خلال 6 أيام. الحين توصلت إلى عرض عمل لدى مصنع بجبل علي بمنصب مدير تصدير، وبعثت لهم صورة الجواز، وتم طلب التأشيرة ولكنها رُفِضت بسبب الحرمان الدائم. صاحب المصنع مستعد لمساعدتي واتخاذ الإجراءات لرفع الحرمان.

Cancellation of a partner visa after selling his shares

Q: My partner is not cancelling his partner visa even though he sold all his shares to me five months before. Now my company trade license renewal is stuck because he is not cancelling his visa. The sponsor is from my side only. How can I cancel his visa without his signature?
