Reducing rent or terminating the contract without penalty because of force majeure

Dear lawyers,

We need your help.

I and my home mate are working in the same airline company as air hostesses and we are renting an apartment together.

We are not flying as it used to be before, because of the coronavirus crisis which means that we are not paid for flying hours and in addition to that, our basic salary is officially deducted by 40%, effective from 1st April. We are now in a critical situation.

We are not able to afford our rent due to force majeure and an unexpected situation. We shared this situation with our landlord, however, he is not showing any goodwill; either for reducing the rental fee or letting us check out from the apartment without penalty (he is basically asking for 1-month notice + 2 months early check out penalty).

I can prove that the latest salary that I will get will be evidence of our situation. Can you help us with legal advice if we can check out without paying any penalty?

Your support will be appreciated.

Our kind regards,

Dear questioner,

If a tenancy contract is terminated prematurely, the tenant has to compensate the landlord for 2 months' rent in lieu of early closure.

If need be, kindly contact us via phone for a detailed discussion or write us an email for further assistance.

Dear Sweta!

Aren’t there any laws that can protect us since we are having a very severe crisis in our business which affects our salaries by 70%. We would like to know about force majeure law which can protect the tenant.

Thanks for your sincere help!

You can sub-rent the apartment and rent another cheaper apartment.

The whole nation is under Corona Attack (force majeure). You can leave and if he stops you, call the police. He can approach the court (The rental dispute organization).

Thank you for your kind response; it’s really helpful.

Shall I go to dispute? And which measures can I take to prevent our landlord (which is a company) from withdrawing my cheques?

Hi,

Your employment circumstances will not affect your tenancy contract. You should check the terms of termination in your tenancy contract and you legally abide by these terms.

In the contract, you can check the notice period and penalties for termination of the contract. Better negotiate with your landlord and resolve amicably.

Feel free to contact me for further consultation.
