How can the manager receive labour rights and enforce the judgment

Q: Hello. I am a manager in the trade license (free zone - DMCC). I am employed, but my employer didn`t pay my salary and don`t want to cancel my visa and don`t want to remove my name from the trade license. I am not a shareholder. I already won a labour case and struggle with the execution department to enforce the judgement as I am still registered as a manager. Seems that I won a case against myself and have to pay myself now. No logic in this and no help from Al-Adheed and free zone. I believe that the solution is in the removal of my name from the trade license, which will force the owner to appoint a new manager and unblock the execution. Please correct me if I am wrong. I am looking for help with the removal of my name from the trade license.

The employment steps after getting an offer letter

Q: Hi, My friend got a job in a restaurant here as a clerk, and the employer gave her a job offer letter and even she did her medical and Emirates ID, there is no stamping from his side. The employer keeps on saying that his trade license is under process. Does it take 3 months to process? It`s more than 3 months that my friend went for issuing medical and Emirates ID. She is not getting a salary as she has not been told to join as of now. What steps can she take?

Terminating the tenancy contract without giving a complete notice period

Q: I was staying in an apartment in Abu Dhabi for 6 years. This year I decided to shift the apartment. I gave 51 days` notice in place of 60 days (2months) for not renewing my contract. The landlord company forced me to deposit 9 days rent and took all of my security deposit as a penalty for short notice period without my agreement. Now, they are refusing to give a receipt for 9 days rent and my security deposit settlement.

Cancellation of a property purchase and refund for over-delay in handover

Q: Hello I am contacting you from London. I have purchased a property in Dubai in a project in 2005. We purchased two apartments and today we have not received anything yet. This construction project is still going on and the developer has changed many times. Another company now runs the project, and whenever I contact them they say it`s going to be ready in the next 3-months or 6-months. It keeps postponing work are currently at standstill. ادعاء موظف على شركة لعدم اتباع الإجراءات اللازمة وخصم نهاية الخدمة

س: أنا مواطن أعمل في إحدى شركات بترول أبوظبي. بعد 5 أعوام تم استدعائي للشركة وطلبوا مني التوقيع على عقد عمل جديد بوظيفة عامل بالدرجة 6 أو 5 علماً بأني كنت بوظيفة مشغل بالدرجة 10، وعلى أن أبدأ من جديد فترة تجربة 6 أشهر بفئة متدرب والعقد السابق لاغي. رفضت ذلك فتم إيقافي عن العمل وإيقاف راتبي وإدخالي للجنة المخالفات بشكل أسبوعي لمدة 7 أشهر دون أن أقوم بأي مخالفة. ثم تم خداعي بأن اللجنة قررت فصلي بقرار تأديبي، وعندما طلبت رؤية القرار ادعت بأنه حتى الآن لم يصل ولكنهم أنهوا خدمتي قبل 4 أيّام. فكيف لم يصل حتى الآن؟ طلبت مني التوقيع لحين وصول القرار ولكني رفضت التوقيع على أي شيء حتى أرى القرار. وبعدها قامت الموظفة بطباعة كتاب الفصل وقام أحد الموظفين بالتوقيع عليه، وطلبت مني التوقيع فرفضت لعدم وجود القرار أساساً وهذا الكتاب باطل. بعدها خاطبوا صندوق التقاعد بطلب شطبي من سجلات موظفي الشركة وادعوا بسبب انقطاعي الطويل عن العمل وأنهم لم يتمكنوا من الوصول إلي لأقوم بالإجراءات، وقاموا بالإجراءات بالنيابة عني وتم صرف المستحقات وقاموا بخصم ربع المكافأة. هل يستطيع القضاء إرجاعي لعملي ان قدمت إثباتات على ما أدعيه؟

كيف يمكن الحجز على ممتلكات الشركة بعد تغيير الشركاء لأخذ المستحقات العمالية؟

س: لدي حكم قضائي بمستحقاتي لدي شركة مقاولات كنت أعمل بها وهي قامت بتغيير اسمها التجاري وتغيير الشركاء ولكن لا يزال لديها مشاريع تحت اسمها السابق وتصرف لهم دفعات. فهل يمكنني الحجز على الأموال التي تصرف لهم؟ لأنني تقدمت لدى محكمة التنفيذ بالحجز على أرصدة البنوك والحجز على الرخصة التجارية ولكن دون جدوى.

هل يجب انتظار إعلان الزوجة بدعوى الطاعة ورفضها لطلب إسقاط النفقة؟

س: السلام عليكم، تقدمت لقاضي التنفيذ في دعوى تنفيذ الطاعة الزوجية بإمارة أبوظبي بطلب شهادة تفيد رفض الزوجة تنفيذ حكم الطاعة. وكان قرار القاضي كالتالي: "بعد الاطلاع تقرر الآتي: استعجال مخاطبة الدعم الاجتماعي لإعلان المنفذ لها بالدخول في طاعة زوجها المنفذ له والرجوع لمسكن الزوجية المعد من قبله. وفي حال عدم تنفيذها لما سبق أعلاه، يتم اعتبارها تحت طائلة ممتنعة عن التنفيذ واستعجالهم بإرفاق الإفادة." هل هذه الإفادة كافية لرفع دعوى إسقاط النفقة أم لا بد من عمل دعوى توجيه أسري لإسقاطها؟ وفي حال أنه لا بد من دعوى توجيه أسري، ما فائدة هذه الافادة؟ وهل إسقاط النفقة يتم عن طريق رفع دعوى ابتدائية أم من خلال قاضي التنفيذ؟
