إمكانية العودة إلى الإمارات بعد الترحيل بسبب بلاغ هروب

س: السلام عليكم، حصلت مشكلة مع كفيلي الذي كنت أعمل لديه سائق خاص. قلت له اعطني رواتبي والغِ إقامتي، قال اصبر خمسة أيام وصبرت ولم أحصل على إجابة. قدمت شكوى في مركز توافق وهناك تفاجأت أنه حرر ضدي بلاغ هروب. عندما حظرني كفيلي اتهمني بقضية جنائية ولكن الحمد لله أخذت فيها براءة وذهب لمركز توافق. استأنفت الشكوى ولم يتم الصلح. أرسلونا للمحكمة وبعد عدة جلسات تم الصلح على إلزام الكفيل بدفع رواتب ثلاثة أشهر وإلزامه بإلغاء الإقامة والحكم يصدر بعد أسبوع. عند خروجي من المحكمة تفاجأت برجال الجوازات يقبضون عليّ. ذهبنا لمركز المخالفين قالوا لازم أن نرحلك فعليك تعميم هروب، فقلت أعلم ذلك ولكن لدي قضية عمالية يصدر الحكم فيها بعد أسبوع والقانون لا يسمح أن يرحلوني وعندي قضية عمالية. كفيلي كان معهم وهددوني بالسجن إن لم أوفق وتم سجني أربعة أيام وبعدها ذهبنا للمطار وأعطوني رواتبي مع خصم مبلغ التذكرة من رواتبي ورحلوني. الحين مضت سنتان ونصف. هل أستطيع الرجوع أم هو حرمان دائم؟ وهل أستطيع تقديم شكوى أو استرحام لدى السفارة الإماراتية في بلدي؟ ولكم جزيل الشكر والتقدير!

Staying in a property if it is not sold after receiving a notice to vacate for selling

The property mortgage was rejected and the seller refused to cancel the MOU

Q: Dear sir/madam, I purchased a villa along with my business partner. The title deed says that we are equal partners in that villa. Later on, the partner signed an affidavit (not notarized) stating that his share of the villa was actually a loan from me, and he would return his share of the villa and also pay 5% interest from the date of the title deed whenever I ask for it. Now, I want my partner to give me his share of the villa but he refuses. So I sent a legal notice. The notice period has expired. Q1. مطالبة المستأجر بالإيجار بعد سنتين من إخلائه للسكن

س: السلام عليكم، استأجرت سكن لمدة سنة وطلبت من المالك عدم التجديد وعمل براءة ذمة وسكنت في مكان آخر بعد أربعة أشهر. بعد سنتين أوقفتني شرطة المطار وأنا قادم من بلدي وأبلغتني أني مطلوب لدفع مبلغ إيجار سنتين لمالك السكن مع أنني لم أسكن به هذه المدة. توجهت إلي بلدية الشارقة وطبعت أوراق القضية ولا أعلم ماذا أفعل؟ مع العلم أن المالك لم يُخطرني أبدًا وهناك مَن كان يسكن من طرف المالك، فماذا أفعل؟ كلمت المالك فقال لي بالحرف: "ادفع وبعد ذلك ساومني وحبة عليك وحبة عليّ"؛ أي نصف المبلغ (٢٠ ألف درهم) بدون وجه حق وأنا أسكن مع أولادي في مكان آخر في هذه الفترة ولدي شهود.

Repercussions of resignation if my limited contract is terminated and kept with no contract

كيفية الحصول على المستحقات العمالية بعد صدور حكم نهائي والتنفيذ

س: السلام عليكم، الاستفسار عن حكم عمالي داخل دولة الإمارات. رفعت شكوى عمالية من شهر ٨/٢٠٢١ وصدر حكم لصالحي بمستحقات ٨ أشهر بدون راتب. تم الاستئناف على الحكم وبعد ذلك صدر حكم آخر لصالحي بنفس المبلغ. فتحت ملف تنفيذي بالفعل وصدرت الخطابات بالحجز على الأموال والمركبات وغيرها وذلك في شهر ١٠/٢٠٢١. بعد طول فترة عدم تحصيلي المبالغ المستحقة لدى الشركة، أرسلت مخاطبة ضبط وإحضار لمدير الشركة وحتى الآن أيضًا لم أحصل على مستحقاتي مما ترتب عليه كثره الديون. ماذا أفعل لتسريع التنفيذ وتحصيل مستحقاتي أم ضاع رزق بناتي؟ علمًا بأن الحكم صدر بمبلغ ٥٤٠٠٠ درهم. الرجاء الإفادة!

Is the tenant responsible for the high electricity bills from a faulty chiller unit?

Q: Dear Sirs, I am facing a serious issue with regards to the chiller unit of my flat. I stay in Ajman in a 2-bedroom flat in a tower owned by a real estate company and the flat owner is an expatriate. My cooling bill from the real estate company is coming abnormally high even when we didn`t use it during the winter the chiller charges keep on coming. So when I contacted the real estate company they send a technician and checked and told me the issue is with the units installed inside the flat not outside and it`s not their responsibility. Then I contacted the flat owner who sent technicians and found some faulty components and replaced them. Now I have incurred a total cooling bill of more than AED 8000 from the real estate company, which was just due to the faulty components of the AC parts installed inside the flat. Am I liable to pay this amount? Both the real estate company and the flat owner refused to take responsibility. Kindly guide me on what options I have. V. C. T.
