A landlord is not abiding by the RERA calculator and wants to increase the rent

Q: Dear sir/madam, My landlord sent me a notice 95 days before expiring of the contract that my rent has been increased by 40% without any justification. I informed the landlord that we should abide by the RERA calculator and sent him an extract of it where it is clearly stated that no increase in rent for the property. After going back and forth multiple times, I decided to visit RDC. They suggested submitting an offer and deposit which got approved according to the RERA calculator. I sent the certificate to the landlord and he replied back that he rejects this. What should I do next? Can I get Ejari with the offer and deposit certificate? Or do I require a tenancy contract with a signature from the landlord?

Is the property seller liable to pay penalty for not fulfilling the obligations of MoU?

Q: Hello, We have signed an MOU in Dubai to purchase a property. The property is under 3 names (Mother, and her two sons, both minors). The MOU has been signed by the mother 3 times (as co-owner, and then as a legal guardian of her two kids). She then went to court to ask the judge for authorization to proceed with the sale for her kids. Should this have been done prior to signing the MOU? The case has been rejected by the judge since there was no specific clause/condition in the MOU for obtaining approval from the judge. Is the seller, at least the mother, liable for the penalty of not being able to complete the transfer due to her own actions as stipulated in the MOU (10%)? Thanks a lot.

Are relatives responsible for a loan taken from a UAE bank?

Q: Hello, I was a resident of UAE and got diagnosed with HIV positive recently. I was asked to leave UAE immediately and left on the same day. I have a personal loan of 600000 AED from a UAE bank. Now I`m back in India taking HIV treatment and I`m almost left with no money for treatment, struggling a lot for daily expenses without an income. Also, I have no property with me to pledge or sell (my parents have a 40-50-year-old property which is in court litigation by my siblings). Now my question is: What consequences will I face and how soon for the unpaid loan in UAE? Can the bank/collection agency claim my parent`s property? I don`t know how long may I live in this world. My kid and wife have no income other than mine. Only by selling my parent`s property, they can lead their life after my death. If this property is claimed by the bank, then I don`t know what to do. This is also affecting my mental pressure and health further. Please advise!

س: السلام عليكم، أنا عامل لدي ملف تنفيذي مفتوح. الشركة مدينة بمبلغ يتجاوز 155 مليون درهم ومديرها الشريك هرب للهند (وتقريبًا يشغل أموالنا في الهند حاليًا)، وفيها شريك مواطن و2 مدراء عاديين. قدمت منع سفر رُفض، وقدمت ضبط وإحضار 4 مرات وأحضرت مستندات أن الشركة تدفع الرواتب حاليًا وتعمل بحسابات بنكية شخصية، القاضي قال: "شركة ذات مسؤولية محدودة لها شخصية قانونية مستقلة عن شخصية المدير المطلوب ضبطه وإحضاره". سألت محامي قال هناك توجيهات عليا بتجنب الضبط والإحضار. إذًا لا منع سفر ولا ضبط ولا أموال؛ كأن القاضي يقول لي تعيش وتشوف غيرها. حصلت على نسخة من رخص تجارية لشركات أخرى الشريك الهارب شريك فيها وفلل تملُّك شخصي. هل يجوز التنفيذ عليها؟ وهل يمكن استدعاء الشريك المواطن للسؤال؟

س: السلام عليكم، كنت أجدد عقد الإيجار ووجدت أن مكتب العقارات يريدني أن أدفع زيادة في الإيجار 10 آلاف درهم. ذهبت إلى مركز فض المنازعات الإيجارية وأخبرتهم بذلك وقالوا لي ليس لهم الحق في زيادة الإيجار وتقدمت بطلب عرض وإيداع لكن مكتب العقارات لم يستجب. ذهبت إلى مركز فض المنازعات مجددًا وقالوا لي ستبدأ بسداد الإيجار عندما يقبلون العرض. بعد خمسة أشهر تحدث مكتب العقارات معي ويريدني أن أذهب لتجديد العقد لكنهم يريدون أن أدفع الزيادة. ذهبت إلى مركز فض المنازعات وتم تحديد جلسة تقاضي وكسبت الدعوى ولدي الحق في تجديد عقد الإيجار بنفس القيمة الإيجارية في العقد السابق. هل يجب أن أدفع الأشهر الماضية؟ وما الحل؟
