Q: I purchased an off-plan property in Ajman back in May 2007.
I was supposed to possess the property by the end of 2009. Till now, the tower has only two floors above the ground and it seems that the construction stopped at that level. I have paid almost 80% of the total value.
I tried several times to reach the Developers, but they are not responding to my emails and phone calls.
What can I do in this situation, and do I have any chances to take my money back?

Q: Delay in property completion and need for cancellation and exit from SPA
Hello All,
I booked for an off-plan property in Downtown Dubai by a leading builder. The completion date was June 2018. However, the property was not completed in June of 2018.
I received a note in April 2018 citing the new completion date would be Dec 2019.
Since the completion date is well over the stipulated grace period in SPA, I had requested the builder for a friendly settlement by cancelling the SPA and refunding the money as per the default by vendor clauses in the SPA.
This has been refuted by the builder and repeatedly says that they cannot cancel the SPA and neither can they refund the money. What are the options available?

Refund case against the developer for project over-delay

Q: We are based in England, and we have invested in one of the projects called Lawns III at Jumeirah Village, Dubai in April 2009.
We paid about AED 448335 to a company called DEC LLC, P.O. Box 333876, and came to know that the project did not even start.
Now, we are chasing to get the refund with no answer from them and would like to know our right to get the refund in full with no delay.
Could you also provide me with legal help in order to submit my case?

Q: Hi,
I had purchased an off-plan property from a developer in 2017. The completion date mentioned in the contract is February 2018.
I have already paid 60% of the sale amount. The percentage completion for the project on the Dubai Land Department says 98% since the last one year.
Can I get the contract cancelled and get my money back?

Cancellation of a villa sale contract for delay in handover

Q: I purchased a villa in 2014 based on 35% during delivery and 65% after handover. I paid all the 35% on time. The anticipated completion date was 31 Jan 2017, until now the project is not completed.
As per the SPA, “if the Purchaser has fulfilled all its obligations in terms of this agreement including, but not limited to, payment of the Purchase Price in full to the Seller, and the Seller is unable to give possession of the property with 12 months of the Anticipated Completion Date, as it may be extended pursuant to the provisions of this agreement, the Purchaser may on the giving of 30 days’ prior written notice to the Seller, terminate this Agreement. Upon termination, the Seller shall refund all amounts paid by the Purchaser to the Seller on account of the Purchase Price. Upon termination of this Agreement, it shall become null and void and the Purchaser shall have no further claim against the Seller for any damages, compensation, cost of interest."

Claiming refund of down payment for delay in property handover

Q: I purchased a property under construction from a developer by paying 10% down payment amount and the remaining 90% to be paid after handover.
As per the SPA, the date of completion is December 2018. But the property is still under construction and will be ready by Dec. 2020.
Can I get my 10% money back and what is the procedure?
Shall I send them a notice or go directly to RERA?

Q: Greetings to all on this helpful forum and many thanks for previous replies.
We have a pertinent question about an execution judgment against a developer in Ajman. The flat was bought in 2006 on plan. By the delivery date Dec. 2008, there were hardly 3 concrete floors.
We had paid by that time AED 155,000. We stopped paying the PDC cheques and opened a civil case. We won a judgment for execution in 2018 for payment of the whole amount plus interest plus expenses.
So far no payment and they seem to be open for business.
Does anyone here on this forum know why that is and how long this can go?
What would be the reason for this delay and are there any assurances that the amount will be paid?
Would a court order for payment remain not executed indefinitely and why?
An answer to my email address would suffice for confidentiality.

Filing criminal and civil cases against a company for cheque bounce 0
Hello,
I hope you're all doing well during this tough time.
I have a question in regards to bounced cheques, specifically corporate cheques.
I have a cheque for AED 800,000, and it has bounced. The owner of the corporate has asked for a month to pay back. However, I am worried he will leave the country and not honour his obligation.
My questions are fairly simple:
1) Am I to put a case on the individual who signed it or the corporate?
1) If I put a criminal and civil case on the corporate right now and he's unable to settle amicably, can I put a travel ban on the owner (who signed) as it is a corporate case?
2) Does the new insolvency law as of late 2019 also apply to corporates?
3) Is the owner personally liable if the company doesn't have assets or cash?
