Refund case against the developer for project over-delay
We are based in England, and we have invested in one of the projects called Lawns III at Jumeirah Village, Dubai in April 2009.
We paid about AED 448335 to a company called DEC LLC, P.O. Box 333876, and came to know that the project did not even start.
Now, we are chasing to get the refund with no answer from them and would like to know our right to get the refund in full with no delay.
Could you also provide me with legal help in order to submit my case?

Further to your query, we believe that the property purchased was off-plan.
Please be informed that we need to review the sale and purchase agreement (SPA) of the property you purchased. Inform us also whether the SPA was registered with the Dubai Land Department or not.
Based on the limited information provided to us, we advise that we can validly claim the entire amount paid for the property on the basis of the default made by the seller.
Prior to instituting the case, we advise you to send a legal notice to the opponent. Some of the companies agree to pay upon receiving a properly drafted legal notice.
