Q: Hi
I paid a deposit and 20% downpayment for each of 2 studio apartments in Dubai in 2008.
I never received a contract for either studio and I contacted the RERA and the developer for years, but they never replied.
I have just learned that the building has now been completed, but I still have no contract or contact.
I don't wish to enter into a contract any longer, how do I get a refund?

Q: REFUND FROM UNPROFESSIONAL DEVELOPER, NO CONTRACT, NO OQOOD, NO PROGRESS
We purchased properties with Royal Estates in DIP - we have paid approximately 25% of the final value already, however they have broken the law on at least 2 issues, as they haven't given us a contract within 15 days of our reservation form plus there is no Oqood. There is no work on the site also.
The developer is constantly making excuses for past two years and is most unprofessional and unhelpful - they are unlawfully keeping our money. The reservation form is null and void as we purchased in 2015.
Is there a way we can get a straightforward refund from the Escrow account that DLD holds? There's no point for a court case as there's no challenge with the developer - anyone can see they have breached law, and I'm sure Dubai want to keep a good reputation to foreign investors without making things legally expensive and messy.
Your advice on the law for this simple situation is appreciated,

Rescinding a property reservation agreement and getting refund

Q: I have purchased a property in Dubai in Dec 2017 by putting a 30% deposit of the purchase price to the Developers account and received the reservation form and receipts only.
However, I still do not have the SPA or OQOOD as of Aug 2018. The developer has been saying the SPA templates have been getting delayed at DLD.
Per the reservation form, I have an upcoming payment in Sep 2018, however, I do not want to pay this as I still don't have the SPA or Oqood which is my legal document and there is no escrow account per DLD website.
What is my legal position here and how can I get this resolved or can I get refunded given there is no contract as yet?

س: أود الاستفسار عن رسوم مقاضاة مطور عقاري اشتريت منه وحدتين عقاريتين.
تم دفع 30% من قيمة العقار + جميع رسوم دائرة الأراضي والأملاك ولكن منذ 7 أشهر يماطل المطور في تسليمي العقد. ولا أعتقد بأن المبالغ المدفوعة تم إيداعها في حساب الضمان.
أيضاً، المشروع متأخر والثاني لم يبدأ بعد مع أنه من خلال نموذج الحجز مذكور بأن عمليات الإنشاء بدأت والتسليم في ديسمبر 2019.
أريد رفع دعوى لفسخ العقد وإرجاع جميع المبالغ المدفوعة. هل الدعوى مضمونة؟
لا أريد تضييع الوقت في تقديم شكاوى لدائرة الأراضي والأملاك.
وأنا من إمارة أخرى وليس لي الوقت للذهاب إلى دبي للشكوى ومراجعتهم. أريد توكيل محامي مختص للانتهاء من الأمر.

الادعاء على مطور عقاري بعد تعليق المشروع

س: السلام عليكم الأساتذة الكرام.
أود استشارتكم بخصوص تقديم شكوى ضد مطور عقاري.
تم حجز شقة بعد دفعة أولى 14 % لحساب المطور العقاري مباشرة بتاريخ 2/3/2019 وكل المرفقات والمراسلات الرسمية موجودة، علماً بأن المشروع قيد الإنشاء 11 % و مسجل لدى التنظيم العقاري في دبي.
تمت المتابعة مع المطور بخصوص إجراء تسجيل الملاك للمباشرة بدفع الاقساط الشهرية لحساب الضمان (escrow) وتأخر المطور بالاستجابة. تبين فيما بعد بأن المطور يواجه مشاكل داخلية وتم تعليق المشروع.
قدمت شكوى بتاريخ 27/4/2019 لدائرة الأراضي والأملاك بجميع المرفقات. هل مطلوب تحويل الطلب للمحكمة وتعيين محامي؟

س: السلام عليكم،
أرغب في توضيح بعض الأمور بخصوص أتعاب المحاماة في قضية عقارية؛ بدءًا من الإنذار القانوني والتفاوض للتسوية أو رفع دعوى أمام المحكمة.
كيف يتم تحصيل أتعاب المحاماة ورسوم المحكمة؟
هل تقوم المحكمة بتحميل الطرف الخاسر كافة أتعاب المحاماة والرسوم مثلاً أم جزء منها؟
وهل تتم المحاسبة قبل القضية أم عند كسبها فقط؟
هل يمكن أن تعين المحكمة أو دائرة الأملاك والأراضي بدبي محامي بالمجان لي؟
علمًا بأنني اشتريت شقة في دبي من مطور عقاري معروف ولم يتم الإنجاز وانتهى وقت التسليم المتفق عليه وقد يكون المشروع قيد الإلغاء.

س: السلام عليكم ورحمة الله وبركاته،
اشتريت عقار (شقة) في دبي في نهاية سنة 2016، وتاريخ الانتهاء المتوقع هو يونيو 2019، ولكن حتى تاريخ هذا اليوم نسبة الإنجاز هي 50% فقط، أريد استرجاع أموالي والمطالبة بالتعويض.
السؤال:
هل الدعوى مضمونة في هذه الحالة؟
وكم أتعاب المحاماه تقريبًا؟
علمًا بأنني دفعت كل الأقساط في موعدها. دفعت 50% تقريبًا من قيمة العقار وأوقفت الأقساط بعد تأخير التسليم.

Good morning!
I have a rented property in Dubai. In March 2024, when I went to visit my flat, I found a subtenant inside. He informed me that he rented from "my tenant" and is paying on a monthly basis.
This occurred without my consent, and his cheques return unpaid. I have heard from my friend about many options to vacate my unit and sue the original tenant.

The possibility of appealing a jail sentence for bounced cheques 0
Hi,
I needed to know if the court issues a judgment of 2 or 3 months jail term in cheque bounce case, is there a way to reverse the judgment or avoid the sentence? Possibly if the creditor withdraws the case?
I have received a judgment of a jail term of 2 months for AED 1 Million security cheque bounce against a loan that is 75% paid off and a 3 months jail term for multiple cheques to a single supplier valued at AED 48,000.00 approx.
What can I do avoid jail terms and wondering how AED 48k cumulative value would result in jail term?
Appreciate a solution for this.

The person is no longer in the country and now there is a civil case on me.
What is the penalty or jail term I would be looking at?

1) A company from the UAE has a subsidiary abroad (100% of the shares).
2) The subsidiary would like to contract an investment loan and the bank is asking for a surety contract issued by the mother company.
3) A legal opinion is necessary to basically present:
3.1) Which conditions the surety contract should comply with in order for the surety contract to be valid and enforceable?
3.2) If any limitation (territorial, financial limit, time to claim, competences, signing procedure that has been followed, or any other, etc) is present in respect of a surety contract assumed by a company from the UAE toward a foreign bank while supporting its subsidiary from abroad.
3.3) What is the legal procedure that applies when enforcing a surety contract that is a related to a subsidiary from abroad (actions / estimated cost / estimated time)?

I have a hold on my bank account even though I have shared all the requested documents with the bank proving that the money belongs to me. However, they keep insisting that the remitting bank requested a recall.
