Q: If salary is given delayed by the employers for 3 months and the employee filed for resignation, is the employer capable of giving a ban to the employee?
And is it legal to deduct 45 days from the settlement because the contract was not finished?

Resignation without notice for holding salaries and changing job

Q: Good afternoon.
I am a specialist doctor working in private sector in Sharjah, UAE. My employer has not paid my salary for more than 6 months (It is much before the Corona outbreak).
According to my contract, my notice period for resignation is 3 months. I have 2 questions:
1. Can I resign with immediate effect without surrendering my salary? Or in other words, is there any relief in notice period?
2. Can I work part-time in another facility without taking a NOC from my current employer?

Resignation before the end of employment contract for holding salaries

Q: I am on an unlimited contract with a school. My contract will end in November 2020, however, I would like to resign as early as this month (July 2020), with 30 days notice.
The reason for resigning is to look for another job to compensate for my financial obligations because we signed an agreement that we have no salary from June 2020 to November 2020 due to pandemic/crisis.
Is there any chance that my employer won't allow me to resign or ban me?

Cancellation of visa and getting labor dues while being abroad

Q: Hi,
I hope you can give me some advice and guidance relating to visa cancellation and departing the UAE.
I am currently employed, by a global company, in the UAE. I have been based between Dubai and Europe, I have not exceeded 6 months outside the UAE during that period.
My current visa expires on 16/10/22. I have taken an offer to transfer to Europe permanently. I have suggested I transfer on the date my current visa expires - 16/10. Do I need to return to the UAE for visa cancellation or, can my employer, as a sponsor, cancel the visa online?
Regarding gratuities, as I understand it, the UAE law is that they must pay this to me before the cancellation of my visa. Can I elect where those gratuities are paid?
I would prefer for the final salary and gratuities to be paid to my account in Europe, can I request or insist on this?

I got terminated for lodging a complaint about non-payment of salary. What to do?

Good day!
Two days ago, I lodged a complaint with the legal team regarding the non-payment of my salary for the past four months. Yesterday, the legal team sent a mail to the company regarding this issue.
However, upon seeing this mail, my company terminated my employment, citing an unspecified reason. They also informed me that I should not come to the company starting tomorrow.
My question is, how can I fulfill my notice period of 30 days if I am not allowed to come to the company?
Additionally, they requested that I hand over the company laptop yesterday. I responded that I would surrender my laptop once I receive my outstanding salary.

Filing a case for wrongfully encashing a guarantee cheque 0
3 years back I had given a post-dated cheque as a guarantee to a person whom I had to pay the money.
In 3 years time before the due date of the post-dated cheque, I had paid him partially by cash and cheque for which I have his signed vouchers and the PDC cheque details.
He was supposed to return back my PDC on the due date and collect the balance amount that was around AED 4000. The cheque value was AED 115,000.
On the due date, he demanded more money from me and when I refused, he bounced the cheque and filed a cheque bounce case.
He said I gave him a cheque of a closed bank account when he asked the money back and claimed the full amount. I was arrested and had to pay the fine for the cheque bounce case.
With the agreement I have with me and the payment voucher proof, can I sue him back for the false accusation?
And can I claim compensation for spoiling my name and image?

Salam,
I was working in Dubai and I needed a 50k loan from the company. My boss told me to do him a favour and take a 700000 loan from the bank then take 50k.
I said how. He planned everything and deposited 30k salary on my account and verify from HR and accounts.
The bank agent gave me the loan he paid instalments almost for one year and then he terminated me and said don't worry we will pay your loan.
After I came back to Pakistan, they are paying but after 3-4 months like that, the recovery company calls me in Pakistan daily. what can I do?
If I come to Dubai and make a case on my boss, will the bank help me or I have to hire lawyer?

My neighbour brother went earlier to Dubai for packing work in a hotel for 2 months. Due to the condition of work & not getting a proper salary, he decided to resign from his job.
When he intimated the same to the employer they said he should pay AED 4500 before leaving & his own ticket. He is from a very poor background that's why he came for AED 900 salary.
But he gets actually 750 only without food. Need your kind support to help him to come back to India.
