Resignation without notice for holding salaries and changing job

Good afternoon.

I am a specialist doctor working in private sector in Sharjah, UAE. My employer has not paid my salary for more than 6 months (It is much before the Corona outbreak).

According to my contract, my notice period for resignation is 3 months. I have 2 questions:

1. Can I resign with immediate effect without surrendering my salary? Or in other words, is there any relief in notice period?

2. Can I work part-time in another facility without taking a NOC from my current employer?

Thanks

Dear questioner,

You can initiate a complaint with MOL for your pending salaries. once it is transferred to court, you can ask for NOC from the labour dept.

This will make your life simple.

If need be, kindly contact us by phone for a detailed discussion or write to us at our email for further assistance.

Yes, you can leave the job immediately and file a complaint with the Ministry of Labor.

And this is considered an arbitrary dismissal and for which you are entitled to compensation from one to three months in addition to your other rights.

As for your work with another party, without a reluctance certificate from the parent company, this is against the law and you may ask for it legally.

You can contact us by phone or email.
