How to get the unpaid rent from the tenant and save time if he plans to file an appeal?

Hi,

I am looking for the following but due to financial constraints, we are low on budget as we have to pay EMI and Mollak for a flat where the tenant is not paying.

1- File the first instance case, in this, I need someone who knows Arabic and can be there with my relative who is the owner of the flat during the first hearing.

2- The opposing party will file an appeal so we have to get the period of appeal reduced by the judge and make it mandatory for the tenant to pay 50% of the rental amount till the time of appeal for filing an appeal.

This is for the eviction of a non-paying tenant.

Welcome.

Filing a Case at First Instance:

You need to file a case at the Rental Disputes Center for the eviction of the non-paying tenant. You should have someone who speaks Arabic accompany the flat owner during the first hearing to assist in communication with the court.

Reducing the Appeal Period:

If the tenant files an appeal, you can request the court to shorten the appeal period and also mandate the tenant to pay 50% of the rental amount during the appeal process.

Cost-Saving Tips:

You can hire a legal assistant or an Arabic-speaking lawyer at a more affordable rate rather than a full-service lawyer.

Consider seeking online legal services or free consultations from legal firms that can help you at a lower cost.

Our office specializes in providing legal advice for rental disputes and property-related issues. We are happy to assist you in this matter with cost-effective legal solutions tailored to your budget.

HI,

If you need someone who speaks Arabic and can accompany your relative (the flat owner) during the first hearing, it's crucial to hire a legal consultant who is experienced in landlord-tenant disputes in the UAE, especially since the proceedings will likely be in Arabic.

In many cases, having a local legal representative who understands the language and procedures will be beneficial.

Before filing the case, ensure you have all the necessary documentation to support your claim, such as the rental contract, proof of non-payment (bank statements, emails, or receipts showing the tenant hasn’t paid), and any previous communications with the tenant.

We can assist you in this matter. Please share your Whatsapp number for further assistance.

Dear Questioner,

Thanks for your inquiry.

According to UAE law, landlords have the right to file a case against non-paying tenants for eviction. The process for filing a case is as follows:

1. File a First Instance Case: The landlord must file a case in the Rent Dispute Settlement Center (RDSC) of the Dubai Land Department. This can be done online or in person. The landlord will need to provide evidence of the non-payment, such as rental contracts, bank statements, and any notices sent to the tenant.

2. Attend the First Hearing: The landlord or their representative must attend the first hearing, which will be scheduled by the RDSC. It is recommended that a legal representative who is fluent in Arabic assist with the proceedings.

3. Mediation: The RDSC will attempt to mediate between the landlord and tenant to reach a settlement. If a settlement is reached, the case will be closed.

4. Decision: If mediation is unsuccessful, the RDSC will issue a decision based on the evidence provided by both parties. If the decision is in favor of the landlord, the tenant will be given a specific period of time to vacate the property.

5. Appeal: The tenant has the right to appeal the decision within 15 days. If the tenant does not appeal within this time period, the decision becomes final and the landlord can proceed with eviction.

To address your specific concerns, the landlord can request the judge to make it mandatory for the tenant to pay 50% of the rental amount.

Please do not hesitate to contact us by phone or email for further guidance.

Greetings

Filing the First-Instance Case: We will prepare and file your case at the Rental Dispute Center (RDC) and represent your relative throughout the proceedings.

Hearing Representation: An Arabic-speaking legal professional from our team will accompany your relative to the first hearing to provide full legal support and ensure clarity in communication.

Appeal Strategy: Should the tenant file an appeal, we will work to request that the judge shorten the appeal period and mandate the tenant to pay 50% of the rental amount pending the outcome of the appeal, per UAE legal provisions.
