Despite custody court order, ex-husband does not return kids. What to do?

Dear Sir/Madam,

I am a French resident in the UAE, living in Dubai. I recently got divorced from a UAE national. My husband took my kids away a year ago, and despite having custody granted by the court for over a year, he has not returned them to me.

I have attempted to see them at their school (a public school in Dubai), but the principal wouldn't allow me, even though I am the legal custodian and mother of the kids.

What can be done?

Dear Questioner,

Initially, the custody order is required to be reviewed and subsequently, we can file for court enforcement of the custody order, compelling your access to the children.

Depending on the father's response, we may pursue criminal complaints, civil lawsuits, or mediation.

You can seek support from child protection services.

Dear Questioner,

I hope this message finds you well!

I understand the challenges you are facing, and I am sorry to hear about your situation. Dealing with child custody matters can be emotionally challenging, and I am here to provide you with the legal guidance and support you need.

In cases where the other party is not complying with a court-ordered custody arrangement, it's essential to take appropriate legal action to enforce your rights. Here are the steps we can consider:

- Legal Consultation:

To better understand the specifics of your case, I recommend scheduling a legal consultation. During this session, we can discuss the details, review relevant documents, and assess the best course of action moving forward.

- Enforcement of Court Orders:

If your ex-husband is not complying with the court-ordered custody arrangement, we can take legal steps to enforce the court's decision. This may involve filing a motion for contempt of court, which could result in penalties for non-compliance.

- Communication with School Authorities:

I can communicate with the school authorities on your behalf to clarify your legal custody status and ensure that they are aware of the court's decision.

This may involve providing them with the necessary legal documentation to support your case.

Please feel free to reach out to me via WhatsApp or phone to schedule a consultation. I am here to assist you and guide you through the legal process to ensure the best possible outcome for you and your children.
