I ordered a car and paid in full but delivery was delayed. Can I cancel the deal and get a refund?

I bought a car from a dealer and paid all costs in cash. They promised to deliver the car within 2-3 days of receiving the full amount.

I paid and forwarded the proof of payment to them on Monday 14 October 2024. I do have a vehicle sales agreement benefiting only the dealer.

Today after begging for a follow-up, they informed me that the car will be delivered next week.

What is my legal position?

Can I cancel the deal and demand a return of my money?

Even though the agreement primarily benefits the dealer, it should outline the terms of delivery.

Check for any clauses regarding delivery timelines and consequences of delays. If the dealer promised delivery within 2-3 days and has failed to do so without a valid reason, this constitutes a breach of contract.

Under the UAE Consumer Protection Law, you have the right to receive the goods you paid for in a timely manner. If the dealer fails to meet this obligation, you have grounds to cancel the deal.

Send a legal notice to the dealer, stating that you expect the delivery as promised and that failure to do so may lead you to cancel the deal. Include a deadline for response.

Thank you very much.

The reason for the delay apparently was the non-availability of the vehicles in the UAE.

the car dealer company only made 2025 models available this weekend or next week. I suppose that is a valid reason?
