Q: Dear Ma'am,
Greetings!
I have a case where we have terminated an employee at 360 days, on an immediate basis.
We have not allowed him to serve a 30 day notice period, however, we have compensated the 30 days through an additional salary.
Please advise if we need to compensate the employee inclusive of the 30 days (notice period) in his leave salary and gratuity?
Or do we take the termination date as the basis of calculation for leave salary and gratuity?
Kindly advise.

Q: Hi,
I got terminated from the company in Jan this year after working there for almost 4 & half years.
They terminated me without any notice & gave me 1 month's salary along with gratuity in my final settlement.
Recently, I came to know through my friend that I should have been given 3 months' salary as they terminated my contract.
I am not aware if it was an unlimited or a limited contract but they only paid me 1 month's salary as compensation.
Please help me in this case, to know if my friend's claim is right.

Q: Under the new law, all contracts will be under the limited contract.
If they terminate you, are you going to receive a notice or not?
My company terminated me and gave me only 1 month's salary but no notice.

How can I claim my labor rights after being forced to resign if I left the UAE?

Q: I worked as a Graphic Designer at a document-clearing service provider company three months ago. During my employment, I was not paid for more than a month.
When I inquired about the payment, my employer shouted at me and canceled my work permit on the same day without any notice.
Additionally, she sent a fake email from my official email account to herself apologizing for some unlawful act.
She called me to come and sort out my remaining dues, but instead, she misguided me to physically resign, which was a big mistake on my part as an employee.
Now, I would like to know what documentary evidence is required to file a complaint. I look forward to your prompt response.
I have all emails and other correspondences except the resignation copy I submitted physically.
Is it possible to complain while outside the UAE because as per policy, I had to exit the UAE in order to change my status?
I also kept snapshots of WhatsApp when she was harassing me.

I was terminated without notice. How can I file a case against my company?

Q: On the 24, I received my termination letter without notice.
When I asked for one day's time, they forced me to sign and I did sign the second warning letter.
I didn’t sign but on that second warning letter, I replied with a written letter with proper details.
I feel like termination is unfair, what should I do now?

Visa cancellation: Sign wrongful EOS or wait six months for automatic cancellation?

Q: Dear lawyers,
I have a question about visa cancellation after termination and need urgent help. I got fired during probation and they told me to return everything immediately and not to serve during the notice period.
So I returned to my home country before my last day of work (just 1 day earlier) due to a family emergency.
After that, they settled my EOS and then initiated the visa cancellation. The EOS letter I signed at that time said "Termination Type: Termination by company".
I was already out of the country at that time and they asked me to come back to UAE to cancel my visa but I didn't. So now they said not to come back but asked me to sign a new EOS letter but this time it says "Termination Type: Out of country".
If I sign this, can they put absconding on me?
Can I just not sign it and wait for 6 months to get my visa canceled automatically?
They do not seem to have good intentions, that's why I need your help to ensure my rights are protected.

Is my DIFC company violating my rights by firing me without notice?

Q: Dear Lawyers,
I have been employed at DIFC since May 1st. They want to fire me without notice, citing a probation period of 3 months, but my contract did not specify a probation period.
Among other things, my contract states that I must be notified 1 month in advance. They have now sent me a screenshot from the DIFC portal prescribing 3 months of probation, but this was not in the contract I signed.
Additionally, the company has not provided me with insurance yet, also citing the probation period.
Is the company violating my rights?

I am the GM of a company in the Internet City and the VP Sales MEAA.
My contract has been terminated after 13 years due to some results that did not meet the company expectations.
