Q: A labour case was ruled in my favour and I received the judgement at the end of 2016. The judgement progressed to execution and not One Dirham has been paid by my ex-employer to date. We have spent the last year searching assets in all banks, combined with real estate, RTA etc. and all have come back with no assets. An attachment was made on the office assets, shortly after the Rental Dispute Committee issued a Judgement awarding the office assets to the Landlord. Finally, we located a valid Bank Guarantee held with a Government Authority. But the entity is not cooperating. As per Federal Law No. 8 for 1980 On Regulation of Labour Relations, Article 4 gives priority over all assets. However, in this scenario, Federal Labour Law, Dubai Real Estate Laws and further laws are all overlapping and conflicting. My query is, is there a document or law that states which law has priority over another to help resolve the issues I am facing with the judgement execution?

Q: I have got a labour case judgement favourable to me. I have filed execution and published in the newspaper. The employers are one Emirati and one Jordanian. They are not responding to the execution procedure. The local employer has personal properties, bank account...etc. Is it possible to file attachment for their personal properties? Q: Hi Madam, I have received a judgment in my favor. The company has to pay my 1-year salary. The judgment has been received but the execution is pending. Every time I visit Al Adheed, they take a fee of 31.5, and a few days later, the execution is rejected. It has happened 2 times, when I asked, they said: "the court didn't finish the fees file". Q: I have an employee who filed a labor case that is in execution. I have tried over the last 2 months to reach an amicable settlement with him on the payment of his settlement. My commitment to him has been based on the commitments I have received from my clients to the company. He initially requested a 25% down payment and 6 PDC checks which I agreed to and he has since rejected that and then demanded 100% of his settlement which he then modified to 50% and 3 PDC checks. I informed him that it would not be possible to pay 50% and 3 PDC checks; the best I could do is 40% and 3 PDC checks as I needed the remaining funds to cover the current employee's medical insurance, some of them have critical medical conditions requiring monthly medication. He has again rejected that and is demanding a 50% down payment to release the case and the block on the company trade license and bank account. I also have other PDC checks due and with a blocked account, these checks will bounce. The settlement is 291KAED.
