Questions & Answers
How can I get my labor rights after filing execution without response from the employer?
I have got the final labor case judgment date of 20/03/2024 and I waited for more than one month, but the company did not respond. So I registered an execution case dated 30/04/2024 in Dubai Courts and issued a notice to the company.
One person visited the company location but a person from the company said that the company was not there, so the court representative took a picture of the location and reported back to the court.
On 23/05/2024, I visited the Al Adheed Center again and they issued a digital notice by email, and till now the company has not responded.
I need your expert advice, what should I do now?

Since the company has not responded to the execution notice despite multiple attempts by the court, you may need to take further legal action to enforce the judgment. Here are some steps you can consider:
1. Follow up with the Court: Contact the Dubai Courts where you registered the execution case and inquire about the next steps. They may provide guidance on the appropriate course of action based on the company's non-response.
2. Seek Legal Advice: Consider consulting with a legal expert, such as a lawyer specializing in labor law or debt collection, for guidance on how to proceed. They can review the details of your case and provide personalized advice on enforcement options.
3. Explore Enforcement Options: Depending on the circumstances and the assets owned by the company, there are various enforcement measures you can consider. These may include seizing company assets, freezing bank accounts, or initiating bankruptcy proceedings against the company.
4. File Complaint with Authorities: If the company is engaging in fraudulent or illegal activities, such as non-payment of labor dues despite having blocked licenses, you may also consider filing a complaint with relevant authorities, such as the Ministry of Human Resources and Emiratization (MOHRE) or the Dubai Economic Department.
5. Monitor Legal Proceedings: Stay informed about any developments in your case, including court hearings, enforcement actions, or responses from the company. Keep documentation of all communications and legal proceedings related to the case.
6. Consider Negotiation: Depending on your priorities and the company's willingness to cooperate, you may also explore the possibility of reaching a settlement through negotiation. This could involve agreeing on a payment plan or other arrangements to satisfy the judgment.
7. Patience and Persistence: Resolving legal matters, especially enforcement of judgments, can take time and effort. Stay patient and persistent in pursuing your rights, and continue to advocate for a fair resolution to your case.
By taking proactive steps and seeking appropriate legal guidance, you can work towards enforcing the judgment and recovering the dues owed to you by the company.
Since the Ministry of Human Resources and Emiratization (MOHRE) blocked the license due to group complaints, inquire with MOHRE if they have any information on the company's assets or the whereabouts of the company representatives.
You may visit the Dubai Courts Execution Department again and inquire about the next steps.
They might suggest additional measures to locate the company or its assets. You can request the Execution Department to investigate the company's reported closure.
This might involve verifying the company's registered address and business activity. If you need further clarification you may ask.
