I have a Labour case against the company and they cannot find them on the registered address. What to do?

I have a labor case against the company; it's a small company working from home. After MOHRE, I filed it in the court.

3 hearings are over already, and the other party has not shown up at any hearings and has not responded to any court notifications.

They are not coming to the registered address, so the court has not been able to serve them properly either.

The trade license is active, and the company is working, putting updates on LinkedIn and all that.

How many more hearings might the court give before giving judgment?

What can be done from my side?

The court may proceed to rule in your favor if the defendant fails to be served after several attempts, especially if you have exhausted all available means of service.

You can take several steps to strengthen your case, including requesting a default judgment, providing evidence that the company is active, and attempting to serve them online.

Hello,

In your labor court case where the company is not attending hearings or responding to notifications, and the court cannot serve them properly, here's what typically happens:

- Courts generally continue scheduling hearings to allow the defendant to appear. However, after several missed hearings (typically around 3 to 5), the court may proceed to issue a default judgment in your favor based on your evidence and the defendant's non-appearance.

- You should inform the court about the defendant’s absence and failure to respond. You may file a request for default judgment if the defendant consistently fails to appear or respond.

- To assist the court, you can provide evidence that the company is avoiding service, for example, by showing the failed attempts at the registered address.

- If the company is active on social media but avoiding legal service, this may support your claim and push the court towards judgment.

- After a default judgment, enforcement measures can be taken against the company to recover your dues, including asset freezing, sponsorship cancellation, and travel bans on company officials.

Your proactive approach would include requesting a default judgment and providing proof of the defendant's avoidance to the court.
