Is it normal to pay maintenance fees upon each rental contract renewal?

Hello,

Regarding the rental contract, I have a term that requires a 2000 AED maintenance fee upon renewal.

Is it normal to pay this fee upon each renewal, and can I negotiate to remove this term from the new contract?

It feels like an overcharge. Renting is in Dubai. Appreciate your help!

Thank you!

Hello questioner,

According to the law regulating rents in Dubai, maintenance expenses are the responsibility of the landlord unless the contract stipulates otherwise.

Since you agreed, in this case, the tenant is responsible for maintenance.

You can contact the landlord to reduce the amount.

For further clarification, share your WhatsApp number.

As per UAE legislation, property owners have the right to levy a maintenance charge for leased properties, which must be clearly outlined in the tenancy agreement regarding the amount and frequency of this fee.

It's common for landlords to impose a maintenance fee upon contract renewal, typically to cover property upkeep expenses like repairs.

If you find the 2000 AED maintenance fee excessive, you can engage in negotiations with your landlord to reduce or eliminate this fee from the new agreement.

It's advisable to address any concerns with your landlord before finalizing the contract.

In case of disagreement, seek guidance from the Rental Dispute Settlement Center (RDSC).

Hi,

Maintenance is usually agreed upon between the parties. Sometimes the owner bears all the maintenance costs, while in other contracts, the tenant does.

Therefore, you can negotiate as you wish. We suggest that the owner should bear any maintenance costs above 500 dirhams.

The contract is based on the law of contracting parties.

Try to discuss with the building management to cancel this condition and change the terms of the contract.

Hi Dear,

This kind of term is not common in rental agreements in Dubai.

However, please note that contracts must be honored (pacta sunt servanda).
