Landlord served sale notice. Unsure of intent to sell. What can I do?

Dear Sir/Madam,

My landlord served me a notice to sell the apartment on the 3rd of April 2023 and extended my contract until the end of this date.

However, there have been no viewings since then, and I don't think they are interested in selling the property.

What action can I take? Do I have to vacate the property at the end of the notice period, as no one has approached me to indicate they've bought the property?

Dear Questioner,

If you suspect that the landlord plans to sell the apartment, then you are not required to vacate the property.

They need to prove it before the court even if they move to file a complaint that the sale is effectuated and the tenant should be evicted.

Dear Client,

Thanks for your question! I hope you are doing well. I will assist you in this matter.

If your landlord has served a notice to sell the property and extended your contract until a specified date, it's essential to communicate with them to inquire about the property's status and the lack of viewings.

Review your lease agreement for specific terms related to property sales and tenant rights. Contact the Real Estate Regulatory Authority (RERA) for guidance if needed.

If you believe your rights as a tenant are not being respected, consult with us. Maintain records of all communication and documents related to the situation.

For any further legal assistance, you can WhatsApp us. We have an extensive team of knowledgeable and experienced lawyers to provide the legal assistance you need.

We will be happy to help you.

Thanks & Regards,

ABDUL WAHIED

You have to continue with the lease contract and the old or new owner may not evict you from the property.

Hi,

Legally, you will have to vacate the property in accordance with the notice.

However, if the landlords list the property for rent, you can file a case and ask for compensation.

Hello,

Yes, you need to evict at the agreed time, but if you are suspicious that he will rent it again, we can file a case on your behalf and claim compensation.

If they re-rent it and don't sell it, then you can file a complaint against him as per law.

Yes, you have to vacate the property. If you want to stay, then you can too.

He will file an eviction lawsuit, and in the lawsuit try to prove that he is not serious about selling the property, and ask to renew the contract.

Dear Inquirer

We are pleased to serve you and address your inquiries.

You must leave the property after the warning period given by the landlord expires, as the law does not require interested buyers to have requested to view the property during this time.

If anything, else is required, don’t hesitate to contact us via email or call our offices in Dubai or Sharjah.
