Questions & Answers
There are pending labor complaints. Can I travel to my home country?
Dear Sir/Madam,
I resigned from my company during my probation period. However, they rejected my resignation, asked for compensation for visa fees, and did not release my salary.
That’s why I filed a complaint to MOHRE. However, they also filed a complaint against me claiming 6000 AED. My complaint to MOHRE is still under process and I am still waiting for an update from them.
I need to return home to my country; however, what's confusing me is whether I am allowed to leave and go back without any issues at the immigration.
The complaint is still under processing and it has not been referred or transferred to court yet.

Hello,
If it is still under process and has not been referred to court, you should be able to leave the country without any issues at the airport.
It is advisable to check with MOHRE directly.
Dear Questioner,
You can return to your country without any problems as long as a judicial decision has not been issued preventing you from traveling.

Dear Questioner,
In accordance with the law, you can resign from the company by providing a 14-day notice period during the probation period.
The employer is required to acknowledge your resignation. There's a possibility that your employer may impose any existing travel bans as the case against you is pending.
It is recommended to resolve any pending cases before departing to prevent future complications when leaving the UAE.
Additionally, please keep track of the expiry date of your visa.

Hi,
According to your query, you will have to check if there is a travel ban on you.
If there is a travel ban placed on your name, you won't be allowed to exit the country.
Dear Client,
Thanks for your question! I hope you are doing well. I will assist you in this matter.
If your complaint to the Ministry of Human Resources and Emiratisation (MOHRE) is still under process and has not been referred to court, you can generally leave the UAE and return to your home country without immediate immigration problems.

Dear Questioner,
As per UAE labor laws, the employee can leave to home country after serving the 14-day notice period during the probation period.
However, in your matter, it would be better to leave the country after resolving the dispute raised in MOHRE.
Please enquire about the case updates through MOHRE.
