Q: Good afternoon.
The company terminated my unlimited full-time employment contract after 3 years, so not renewing my visa. I am working on my own visa now and continue as a freelancer.
But they want me to sign their freelance/consultancy agreement with a clause that I am not allowed to work for any of their competitors (but they don't provide me with a visa, medical, no benefits, even not giving me enough working hours).
1) Is it legal to ask a freelancer for this exclusivity?
2) How I can be a freelancer and not allowed to work for other companies?
3) What shall I do if I still want to continue working with them but need other jobs in other companies to have enough income to pay my bills?
4) Am I entitled to gratuity? Because they didn't mention it.

How to obtain a NOC from employer if you want to be a partner in another business?

Q: I am currently working in an organization on an unlimited contract, however, I would like to enter into a business partnership and put my name on the trade license of the new company.
I will, however, still be working in my current company. Can I enter into a business partnership directly or do I need to get a NOC?
My current employer has no restriction on doing business in our contract neither does the new business violate the non-compete clause.
If I need to get a NOC, then how do I do it? Do I simply request my current company to give a NOC?

Q: Hi!
Good day!
It has been almost 4 years of working as a security guard in a Dubai-based company on a limited contract and recently I got a job offer overseas (Malta).
In order to get the visa, I need a No Objection Letter from my employer, which the employer rejected.
So, Is there any way to get NOC from my employer? Or does the MOHRE or Labour Court issue the NOC on the employer's behalf?

Q: I am the owner of a tour operator company in Dubai that provides chauffeur services to our clients. I am seeking guidance on the legal requirements for hiring chauffeurs who already possess valid visas, as I do not intend to provide visas myself.
Specifically, I would like to know which documents I must prepare to comply with UAE law, aside from a contractual agreement.
Is it necessary to obtain a No Objection Certificate (NOC) from the company that issued their current visa?
Additionally, should the contract explicitly state that they are third-party contractors with my company?
What else should be included in the contractual agreement?
One of the driver’s CVs states that he has a partner visa. What law would apply in this scenario?
Your expertise on this matter would be greatly appreciated.

After working with them for 1 month, I experienced a salary delay, and I had to go to the office to ask why there was a delay in my salary.
That is when the HR told me she deducted my whole salary to recover the transfer fee.
Now my question is, who is supposed to pay for the transfer fee, the employee or the employer?

I want to inquire regarding my leave privileges. I am now 11 months in my company. How many leaves am I privileged to?
Based on Decree-Law No. 33 of 2021 regulating labour relations and its executive regulations, you are entitled to a paid weekly rest for not less than one day, as specified in the work contract or the work regulation.
The Council of Ministers may increase the weekly rest day stipulated in this article. The Decree-Law and its executive regulations also stipulate that you are entitled to an annual leave with full pay as follows:
- Thirty days for each year of your extended service.
- Two days per month in respect of any employee with more than six months and less than one year of service.
- Leave for parts of the last year of your service in case it is terminated before you use your annual leave balance.
Now my question is: do I have 22 days I can use? Can someone explain to me in detail?

My company has filed a complaint against me in MOHRE related to training fees.
This is the clause mentioned in my contract:
"The Second Party shall be obliged to pay back the value of the training (which is estimated at an amount of 10000 AED) when they terminate the employment contract based on their own free will (within One Year) from the date of commencement of their contract, without prejudice to the First Party's legal or contractual obligations. (the amount agreed on for the value of the training period must be commensurate with the employment period of the employee)"
My question is:
1. I served 11 months in the company. Can they demand the full 10,000 or it should be less due to 11 months (as per the last line of the clause)?
2. I didn't even get training from the company. I learned normally by working on projects with seniors. No training session was conducted for me. Should I still have to pay?
My case is in MOHRE.
